    The FMCSA has requested comments on C.R. England, Inc.’s application for exemption from the FMCSA’s Federal minimum training requirements in#49 CFR 383.25(a)(1), which requires that a commercial learner’s permit (CLP) holder must always be accompanied by a commercial driver’s licensed holder with the proper CDL class and endorsements. #Additionally, the rule requires that the CDL holder/driver trainer be seated in the front seat and on-duty while the CLP driver is behind-the-wheel.


    “FMCSA announces that C.R. England, Inc. (C.R. England) has applied for an exemption from the Federal minimum training conditions in 49 CFR 383.25(a)(1) that require a commercial learner’s permit (CLP) holder to always be accompanied by a commercial driver’s license (CDL) holder with the proper CDL class and endorsements seated in the front seat of the vehicle while the CLP holder performs behind-the-wheel training on public roads or highways. C.R. England requests an exemption to allow CLP holders who have passed the CDL skills test but not yet received the CDL document to drive a commercial motor vehicle without being accompanied by a CDL holder, provided the driver has documentation of passing the skills test. C.R. England believes that the exemption, if granted, would allow such a driver to operate more freely and in a way that benefits the driver, the carrier, and the economy as a whole.”

    “C.R. England seeks exemption from#49 CFR 383.25(a)(1) that would issued by the state of domicile.” the Federal Register states.

    In its request, C.R. England cited the growing need for well-trained, and well-qualified drivers to meet today’s shipping demands.

    All they are asking is that they be able to drive with a temporary license they get when they pass the test before the real one comes in the mail. Just like you can with class D licenses, at least in New York.

    i about fell over when i read this earlier today. anyway, should be interesting to see what fmccasasaswsadfss what ever they call themselves says. it will say a lot about how they are looking to re-write the rules for driver training. now in NO WAY am i saying i support their exemption, but let me play devils advocate here... they exempt a boat load of stuff. for example HOS rules. i haul sand in Texas. I can legally drive 12 hours a day and NOT take that pesky 30 minute break, and i only need 8 hours off not 10. plus my resets are complete in 24 hours off duty. when i took this job i instantly became a super trucker compared to every other regular OTR driver out there. i mean obviously i'm a lot better and safer driver than all y'all if i get to do this... or is it all about the money? you decide.

    The temporary license NY issues after passing the road test is a real CDL. The OP stated they are seeking exemption for permit holders.

    CR England is seeking exemption for permit holders because they are still considered permit holders after passing their skills test but before receiving their CDL document in the mail. That is what they are trying to change.

    And the CDL manual for NY does state that you can not drive a CDL vehicle by yourself before receiving the document.

    Edit: I'll retract what I said about NY because I just read the CDL manual on the website and they changed it as far as I can see.

    1.3.9: "If you pass, you may be eligible for a temporary license at the road test site. However, all individuals who pass a road test will be instructed to wait 7 days before going to DMV to request their permanent license."

    Whats the fuss? Frankly the extended training/hand holding shouldn't be necessary. Providing they have good dispatchers and planners. Way too much coddling today.

    To me it sounds like that want it for the people that are waiting for the real deal CDL to come in the mail.
    I am sure the 7 day wait is so the states have time to enter everything into the system before sending the real deal out.
    Now this 7 day wait what if you are out on the road, you may not have the real deal in hand for weeks.
    Don't some Co.'s pay more when you are out on your own so needing to wait is taking money out of that persons pocket no?

    This is exactly what many of us have said on this board about CRE. And now they want to make it legal. Not good and if it passes it sets a bad precedent. Good find drvrtech.
