Truckers Meal Breaks in California

The American Trucking Associations and the California Trucking Association are seeking a change in a state law requiring employees to take a meal break after five hours of work. The law currently states that, by the fifth hour of work, employees have to clock out and take a break.

The associations would like to see an exemption such as that given to employees on movie sets. In the motion picture industry, employees must take a meal break if they work six hours or more. The truckers want an exemption that allows drivers to incorporate breaks into their route and how they transport goods. Companies and employees need flexibility to determine what works best.

I find it somewhat hilarious that the states continually exempt truckers from all the usual provisions of the Fair Labor Standards Act and it's hourly provisions, but then seek to regulate truckers based on the same hourly basis that they have declared them exempt from. What a freaking nightmare.
