Man admits to making truck drivers pay bribes

Man admits to making truck drivers pay bribes
3/12/08
Lodi News-Sentinel, CA
Quote:
A Lodi man must repay truckers a total of $46,000 and could spend up to a year in jail after pleading guilty in a case prosecutors said was San Joaquin County's first commercial bribery prosecution.

James Melvin Canclini, 42, pleaded guilty Wednesday to one felony count each of tax evasion and grand theft, as well as a misdemeanor charge of harassing some of the witnesses who would later testify against him.

Canclini, who had spent his entire adult life working for T&T Trucking, pleaded guilty on the second day of his preliminary hearing, Deputy District Attorney Steve Taylor said Thursday.

Until he was fired, Canclini was working as a dispatcher at the trucking firm, located in south Lodi on the east Highway 99 Frontage Road. For at least three years, he took money from truck drivers, in exchange for preferable delivery runs.

If a truck driver did not cooperate, Canclini would either not give the trucker any jobs or would send him on the runs he did not want.

2 years to investigate this, the tip of a monstrous iceberg that is going to sink the trucking industry as we know if if the government begin to police the rest of the trucking industry with the same zeal as they do the drivers and truck owners!!

Is this fairly common? I have heard about some "informal" dealings to get preferable loads, but a straight cash payment?

I wouldn't agree to suing you.Why tie the the courts up.Now if somebody wanted drag you down a gravel road behind their truck, that I could agree to.

Sounds like the trucking industry has learned from Vegas about how tips work, perhaps through a teamster tutorial.

Trust me,I've got it straight...If a person is getting paid to dispatch and then takes money out of an o/o hand then any way you spin it ITS A BRIBE.Call it a gift or a present from Santa its still what it is. I know its very unethical and its probably illegal to do it.I know that about 5 yrs ago a couple of o/o left 3 dispatchers beat to a bloody pulp in a parking lot after a christmas party for the exact same thing and it stopped at that company.Maybe you need to get your straight edge out and straighten YOUR $%^# out.

I'm still yet to be a beaten in a fight, i dunno maybe my muy-tay is too superior..i do agree that what that guy did was wrong because apparently there was competition among O/O at his company...where i work everybody was happy we only had 15 o/os everybody was taken care of in a good way they were just so happy working with us that they felt like they would bring pizza once in awhile etc..including money..ive never asked for it infact sometimes i told them noooooo but they would still drop cash outside in my car window lol...what do u do?

As for you never being beaten in a fight ,I've heard that line a trillion times so I guess I'm the only guy who's ever been whipped and as for your muy-tay ,I'll have to take your word for that .lol.All I'm saying is....If a person is dispatching AND an o/o hands YOU cash and says"Thanks for that run to such and such the other day" that is a bribe and if the other o/o on your board find out about it they should school you and that o/o on ethics and on how to properly fill out insurance forms at your local emergency room.At the least it would give the o/o who didn't give you gifts a reason to b!tch and whine every single time you sent them what they considered a crappy load(and you know they would complain). Now the pizza deal and things like that I really don't see a problem with and I've actually had a dispatcher or two that I really liked and thought watched out very well for me and the drivers on his board.A few other guys ribbed me about being a suckazz and every good load I got they joked with me about it but I have a decent rep so it was all in fun.No prob with taking him out to lunch and such. But I'm not kidding you in the least...Any o/o I've ever know worth his salt that found out CASH bribes, gifts or whatever was taking place it turned into a nasty deal with the dispatcher getting fired at the least and the worst was the "Great Christmas ### Kicking Party of '02.Thats all I'm saying about it.As for them dropping dinero outside your door,I'd hate to see that money blow away in the wind too.lol
