I actually contacted CARB and what they said is that it is basically up to the discretion of the officer. Seeing as no officer would be willing to fine a driver because he's keeping his animal safe, they wouldn't write up the driver for keeping his truck idling with an animal in it.

That being said, since it is also up to the discretion of the officer, it could be argued that any time the sun is out and the temperature is above 80F, it would also be unsafe to shut down the vehicle and put the driver at risk. Whether an officer would use this kind of logic, especially in CA, is subject to debate.

But, no, it definitely is NOT in the written wording of the law, which is why the folks running CA are perpetually some of the least effective in the nation. I should know, I lived in Orange County there for the first 35 years of my life and finally decided that even there, it was no longer a place to raise a family.

thanks for the links "guys lady". what youv'e posted is what drivers need to know.soon you'll see other states adopting these same regs (some already have).many of the truckstops are now posting the no-idle warnings here in CA.got to be one of the worst type of laws passed,yet over the years ALL laws regarding trucking have never been in the driver's best interests

California Officers actually EXERCISING "discretion"?? HA! That is the most unheard of thing I have ever heard of!

I have almost 200 pages of paperwork on all of this nonsense, for here in the state of California. I probably have 100 links on all of this stuff. It keeps growing and changing at a rate I can no longer keep up with!

Keeping up with revisions, meetings, and keepig drivers educated and united has been more than a full time task, even just in my home county! What makes it harder is when I present them with evidence of exactly what I am saying, and they choose not to believe me. I have talked and talked and talked, and there are those who still choose not to listen.

I have sat in on countless CARB meetings; I KNOW what these people are doing.

When CARB chooses not to listen, and drivers and owners choose not to listen.. Do you all know how discouraging it gets to those of us trying to fight for the rights of the drivers?

DO NOT BELIEVE anything you cannot PROVE where CARB is concerned!

CARB fines company $43,000 for truck emissions violations

CARB said the company failed to inspect its heavy-duty diesel trucks at its California terminals in Hayward, San Jose, Sacramento, Modesto, Chico, Yuba City, Woodland, Fresno, Lodi, Stockton, Diamond Springs, Concord, Merced, Susanville, Turlock, Santa Rosa, Redding, San Francisco, Salinas, San Carlos, Dublin and Visalia.

In addition to the fines, the company will revise its truck engine software for low-NOx programming. It will also ensure that all diesel trucks meet federal emission standards and are labeled with the correct engine certification label.
“Healthy air quality is something to which everyone can contribute,” CARB Chairman Mary Nichols stated in a news release. “When businesses do their part, everyone wins. When they don’t, public health is put at risk.”

California Big Rigs Face First U.S. Emission Curbs

Oct. 24 (Bloomberg) -- The first U.S. rules regulating diesel pollution spewed from ``big rigs'' were released by California regulators, affecting roughly 1 million trucks carrying goods around the state.
The California Air Resources Board measures would require trucks operating in the state to install technology that improves efficiency and reduces smog-forming emissions. The rules, which would take effect in 2010, are opposed by the trucking industry because of its estimated $5.5 billion cost.
Heavy-duty rigs are the largest remaining source of unregulated diesel emissions, responsible for 32 percent of smog- forming pollution in California, the board said. Diesel exhaust is associated with cancer as well as cardiovascular and respiratory problems. The board said the rules are expected to save 9,400 lives from 2010 to 2025.

Solution: All goods bound for California will be dropped off at the Nevada, Oregon, Arizona, and Mexican borders.
All goods bound for points unknown will be hand carried to these same borders.
Viola! No more smog produced by Big trucks, just smog produced by the eleventy billion people that live there...and Arnolds fleet of Hummers.
