Trucker's lawsuit rejected

Trucker's lawsuit rejected
9/12/08
Stockton Record, CA
Quote:
STOCKTON - Jurors rejected a Sacramento trucker's bid in court Thursday for payment from the state and a big-rig maker for a 1997 accident caused by a Stockton teenager who threw a chunk of concrete in his path on Interstate 5.
Billy Collins has been in a vegetative state and under constant medical care since Joshua Daniel, then 15, threw a 21/2-pound piece of roadside debris at him. Daniel remains in state prison, and Collins is in a Sacramento-area care home. Collins, 60, and his wife, Barbara, blamed Caltrans for failing to fence off the dangerous roadway from pedestrian access. Navistar International Corp. was at fault because the truck's windshield didn't withstand a heavy blow, the couple's attorneys argued.

Just remember guys.

It could happen to anyone of us at anytime. Just how much insurance do you think you have to cover yourself?

If a company driver, how much do you really think workmen's comp will pay?

If an owner operator, you may only have health insurance.

Maybe the kid and his family should be paying for this.

Considering that my father was nearly killed by a rock through the windshield, yeah, take the kid and drop a rock on him.

My father and my grandfather were coming home from work a few years ago. A pickup truck with a bunch of teenagers was coming in the opposite lane and hurling rocks through people's windshields. They got my father's van, and my father and grandfather were narrowly missed because the rock passed through near the center of the windshield and then traveled along the lenght of the van, exiting one of the rear door windows. If my father had been sitting in one of the back bench seats, or if I had been riding with them, either he or I would have been instantly killed.

I don't disagree. I was just trying to show why the lawsuit may be the way it is.

Most health insurance is limited in the max and the same with workmen's comp.

After the kid gets stuck and his family, how many times do you think it would ever happen again?
