Remember that 30-truck, chain reaction tunnel crash on the SB I-5 on Oct 12, 2007 in Santa Clarita ?? Investigators concluded it was partly caused by a leaking grease oil seal (wheel bearing axle oil) on the right-front steering axle, causing a decreased braking power on the right-front brake. Who ever wrote the article should've consulted a truck mechanic to ascertain how grease oil can end up in the front disk brake area. click here ► [LINK POSTED BY MEMBER] Only Members Can View This Truck Forum Link.
The article says "CHP officials believed that Reyes would have been able to see the safety problem when he conducted a required inspection of the vehicle..." --- yeah, if he crawled underneath with a flashlight ‼ This is why the prosecution isn't filing charges, drivers don't normally crawl underneath the truck to perform safety checks ‼
What I find most intriguing about this news, they never mentioned those 9 truckers who fled the scene of the accident. Guess the CHP is going to ignore the significance of what 30% of drivers fleeing the scene of an accident means; the state of California had issued CDLs to illegal aliens who used fake social security cards and fake birth certificates to secure their license ‼ Those drivers fled because they were afraid CHP was going to take their fingerprints and cross reference them with records of illegal aliens who had already been deported in the past, and had snuck back into the USA ‼

Passingtrucker, Do you know for a fact that the drivers of those trucks were illegal? Just asking, I know you are from out that way.... as that article they used every excuse not to prosecute Reyes or SAIA for the accident... Hummm strange, I smell some thing fishy here???? Who's getting paid here? Any way, I understand how and why you would come to the reasonable conculuision you did. None of the drivers following behind Reyes are at fault, following to close, to fast for conditions, speeding... and the list can go on. And the wheels of justice come to a hault, 'cuz we might offend some one or group... Makes me sick....

This is the gist of "Special Order 40" which the ACLU and The CA courts have interpreted as the "Law of the Land" for protecting the rights of Illegal Aliens.

If this was true then why are the CHP working hand in hand with the border patrol on interstate 8 working road blocks looking for illegal aliens?? ive been on that highway several times seeing CHP and border patrol working together just for that.. someone isnt paying much attention here.. or is full of themselves.

Illegal aliens don't go through the border checks.....
If they were their only (the border checks) routes, they'd all be caught and we wouldn't be having this conversation now would we?
Why is that CA alone has an estimate 10 million illegals living throughout the state?

You have to come to CA and see with your own eyes, the magnitude of the problem

Within days after this incident happened, I relayed my concerns to my neighbor down the street, who's with the CHP, and he said he'll pass it on to his superiors. He tells me 3 months later its a jurisdiction issue; the CHP does not have the power to investigate illegal aliens using fraudulant documents to secure a CDL. As to how I know they're licensed, the insurance companies had paid the claims on all the trucks that had burned up. You have to be pre-approved by the insurance company, in order for then to cover the liability risk. All the drivers were the authorized licensed drivers at that time. They fled the scene because other states routinely collect fingerprints (in truck accidents) when they suspect the driver may be here illegally. Had you spoken to a CHP officer lately, and asked him how prevalent are Hispanic truckers abandoning their rigs and fleeing the scene of an accident, in CA alone ??
Are you defensive of these Latino Hispanic drivers because, as a fleet owner, you hire a number of Hispanic drivers yourself ?? Are you bending to the pressures of your clients, who want you to keep your rates low at any cost ??

This was instituted in 1979 by LAPD, a city police department. Their policies are irrelevent to CHP, a state police department. Since 9-11 Twin Towers, federal executive orders instituted by Bush takes precedence over concerns of maintaining public relations between law enforcement and illegal aliens. The number of Republican presidential hopefuls who failed to win the leading candidate for the Republican Presidential ticket had championed cracking down on illegal aliens, which may had contributed to the Republicans defeat against Obama. Observe that McCain had distanced himself on the issue of illegal aliens, knowing that a significant number of Americans (employers) support illegal aliens in the USA. States such as California is strongly against crack downs on illegal aliens, because a significant number of CA employers rely on illegal aliens. You need only to ask any driver who had picked up or delivered in a CA warehouse how many staff employees speak little or no English.
A federal statute had been added to make it a felony to reenter the USA after having been deported in the past. This [LINK POSTED BY MEMBER] Only Members Can View This Truck Forum Link. that upgrades the crime to a felony is why Hispanic truckers are fleeing the scene of accidents ‼

Its a jurisdiction issue; if people are suspected of human trafficing, only INS can run a check to cross reference their data bank on running ID checks on detained suspects. If INS cannot respond within a short time frame (15 minutes or less) when CHP request assistance on suspected detained cayotes, they'll have to let the suspects go free. The 30-mile area along the Mexican border is plagued with cayotes trafficing human cargo from Mexico. When INS confirms them to be illegals, CHP are only there to assist, but the arrest is conducted by INS. What you had witnessed is a joint agency task force. CHP is a CA state police, while INS is a federal police force.

My point regarding Special Order 40 is that several courts have used its example to interpret laws and legislators have used it as a guide to write pro-illegal alien laws.
Laws are based on what is acceptable or not; and what is practiced in society.
