Appeals court sides with Ala. on railroad tax suit

MONTGOMERY, Ala. — A federal appeals court has sided with Alabama in a lawsuit filed by Norfolk Southern Railway Co. that could have wiped out several million dollars in taxes that support public education.
Norfolk Southern claimed the state's 4 percent sales and use tax on diesel fuel used by railroads is discriminatory because the railroads' competition, the trucking industry, doesn't pay the same tax.
But in a 3-0 decision Thursday, the 11th U.S. Circuit Court of Appeals in Atlanta said the sales and use tax is not discriminatory because it does not single out railroads. The court also noted that trucking companies pay other taxes on fuel that railroads don't pay.

Look at it from the RR point of view they have to pay to REPLACE their entire INFASTRUCTURE out of their own pocket then pay PROPERTY TAXES ON TOP OF THAT. You think the UAW gets paid alot The RR have their own SE#PARATE RETIREMERNT SYSTEM FUNDED BY THE RR's AND FEDERAL GOVERMENT THAT WOULD MAKE SOCIAL SECURITEY BLUSH. LAST YEAR ALONE NS PAID IN ALABAMA IN PROPERTY TAXES 400 MILLION DOLLARS YET THEY STILL WANTED MORE FROM THEM IN A 4% TAX ON THE FUEL THAT THE ENGINES BURNED BTW DID NOT MATTER IF THE FUEL WAS BOUGHT IN THE STAE OR NOT THEY GOT TAXED ON THE CAPICITY OF THE LOCOMOTIVE TANKS AND A C-40-9 NS MOST COMMON TYPE HOLDS 5000 GALLONS. Now at a price 2.25 a gallon that is what NS hedged for THIS YEAR you do the math I think NS reported that this was going to cost them somewhere around 9 million extra in fuel costs.
