FMCSA tightens new entrant rules

New entrants will have to survive a more rigorous test of their safety fitness under new rules issued by the Federal Motor Carrier Safety Administration. The regulations, to be published in the Dec. 16 Federal Register, identify 16 violations that FMCSA deems to be essential elements of basic safety management controls necessary to operate in interstate commerce. Failure to comply with any one of those 16 regulations results in an automatic failure of the new entrant safety audit, which is supposed to occur within the first 18 months of a new entrant’s operation.

These new rules are pretty basic, the least common denominator. When I had my safety audits, I think I would have failed if any of these listed disqualifications existed in my company. These guys in Michigan were pretty tough.

But, there are probably more than a few outfits running out here that would fit this ax rule. Like the guy pulling the tanker that flipped and killed the hockey family. Ten driving violations dragging 9000 gals of gasoline? Yea, just the guy I want driving one of my trucks. But that is pretty common up here with all of the foreigner's up here driving trucks. It is actually bragging rights. But they get away with it, no speaky engleesh.
