    I know Gordon won't hire WA drivers because of it. My understanding is the overtime laws only apply to WA residents. I know other states have o/t laws, surprised there hasn't been more lawsuits.

    The reason I posted a comment in the first place was that I had just been notified of certain embezzlement problems within Interstate. As I looked online, I found this thread near the top of the Google search. I also found out on other websites that they haven't paid their O/O's since July 2010, and many of their company drivers are also not being paid. I knew Larry Westberry, worked with him. He is not the "Law-breaking disgruntled former employee we fired for company policy infractions" as Interstate spokespersons are saying. He is a hardworking, careful driver who is an asset to ANY long haul outfit. I went to the suing law firm's site, got their info, and called them today. I'm waiting for a callback because I want to know what is going on. I wonder if the embezzled $300,000,000.00 (only gossip I heard at this point) is part of a planned action by Interstate to try to make themselves less solvent and unable to pay the fines the state of Washington is going to levy on them. As i said, they have proven to me literally that they will go to great lengths to avoid being responsible. I know so much about the goings-on of IDC up to the time I left in 2008 that I could write an expos`e book about them. I have no plans for that but it sure is strange how that what goes around comes around... The 2 year rule isn't a solid thing, it's only a general guideline for many legal matters. The one year rule for medical problems is "one year from the point of last seeing a doctor or having paid the final bill for treatment of any on-the-job injury. (paraphrased) This means that it could actually stretch indefinitely. I was told that an IDC employee did a dance and yelled "yahoo" when the date of my on-the-job injury passed the 365 day mark. I'm not planning to sue them, never really did plan on that, but it shows how misinformed they are. They are ridiculous. When B,S & S law firm calls me back I'll post what they tell me about the Westberry overtime case.

    I do believe that Interstate was cleared of this allegation. On web site WWW.Courts.Wa.gov. It lists this case and states that on April 2, 2010, Judge Kathryn Nelson, Superior Court, dismissed the case. Supposedly Interstate somehow has implimented a pay scale which incorporates the overtime. How I dont know.

    the guy in question was trying to mix apples and bananas. federal wage laws say if you work more than 40 hours then everything after to 40 is overtime this only applies if you are paid by the hour. but if you are paid mileage, piece work, etc,etc then the overtime is already figured in. all you have to do is read the poster that should be posted somewhere by h.r.

    Federal wage and labor laws exempt safety related jobs (drivers) who are involved in interstate commerce from over time pay and has since about 1934 under the Interstate Commerce Commission.

    I'm really curious to know what could have possibly made anyone even begin to think they stood a snowball's chance of legally establishing anywhere in the U.S., in the early 21st century, a time-and-a-half overtime rate for OTR truck driving? I sure hope no trucker lost any money on that insane bet.

    considering they want us to work an 8hr day, and limit us to 70hrs per week, i can see a logic behind overtime after 40 hrs

    either that, or let us do what we do and be treated like adult professionals instead of babysat by the fmcsa guidelines

    If they wanted us to only work 8 hour days we'd be limited to 56 hours in 7 days , not 70 in 8 days (not 70 hours in a week ). The reason drivers aren't taken seriously is the majority of those complaining show they don't comprehend what they are complaining about .
