Unhappy Trucker may face 10 charges

Quote:
MIAMI, Okla. — The driver of a tractor-trailer rig involved in one of the deadliest vehicle crashes in Oklahoma history could face as many as 10 negligent homicide charges for his role in the accident, an Ottawa County prosecutor said Monday.

District Attorney Eddie Wyant said that, based on what he knows now about Friday's crash on the Will Rogers Turnpike, the driver of the truck, Donald Creed, 76, of Willard, Mo., could face one count of negligent homicide for each of the 10 people who were killed in the crash.

"He could have dozed off or he could have been text-messaging," Wyant said. "It's hard to say until I get the final reports."

But none of that matters, he said. All that matters is that Creed apparently was operating his truck in a negligent manner, and that's enough for a charge of negligent homicide, Wyant said.
My prayers go out to the families of those who perished, and are injured.

This, however, looks to me like, no matter what, the trucker is going to be blamed.
It won't matter if he was/is taking a legally prescribed medication, that has no affect on his driving ability, if he was/is on any meds, this will be blamed...it seems to me this is the way this will go.

Patrol: Big rig brakes in 10-fatality accident OK

Patrol: Big rig brakes in 10-fatality accident OK

Quote:
OKLAHOMA CITY — The Oklahoma Highway Patrol said Tuesday that it found no problems with the brakes on a tractor-trailer that plowed into stalled cars in an accident on the Will Rogers Turnpike that killed 10 people.

Capt. Craig Medcalf, who leads the patrol’s Motor Carrier Enforcement Division, said the assessment was based on an examination of the big rig’s brake pads, which he said appeared to be in good condition. Medcalf said the damage to the undercarriage of the tractor was so extensive that troopers couldn’t test the performance of the brakes.

i live just off the turnpike in Quapaw, ok and i seen this wreck from the overpass at mile marker 322 this had to be the most horrific accident i have ever seen in 20 years of driving a truck. I know one of the local dot officer's that works the wreck(we attend the same church) according to him the drivers log book, medical card, was up to date-he even came back clean on the accident drug test and all equipment was good and his cell phone records were clear which means he was not using it or texting at the time of the accident. The officers opinion was of the fact maybe the driver's age came into play you know reaction time not being what it used to be

This is a terrible tragedy from every angle. The poor families that lost their loved ones our hearts go out to you. The truck driver who it seems did nothing illegal or wrong except not get stopped will no doubt suffer the rest of his life and likely have nightmares and worse from this horrific accident. Undoubtedly the driver will be the blame and receive the punishment for this. This is a lose lose for everybody involved. Very sad.

That was my first thought as well. Seventy Six is officially old! It's too old to be working, especially in a field such as trucking where all your faculties need to be fully operational. It's not even close to being middle age unless you plan on living as long a [LINK POSTED BY MEMBER] Only Members Can View This Truck Forum Link. . Granted some people drive into their 80's and are as quick and sharp as a 50 year old; but most others cannot.

My good friends grandpa is still driving OTR at 87. He's been trucking for 50 some years and all accident free. I would agree that most would not be capable of this though at that age.At least the ones I know that age.

A friend of mine died at 36. I guess truck drivers should not be driving over that age either. He died of a heart related issue.

In my opinion I believe trucking should be light the airlines. You reach a certain age your done. I know there are many "older" drivers out there. I am speaking of the 70+ ones. But studies have proven your more of an accident risk as you graduate in years. Just like teenagers are higher risk. We don't allow anyone under 21 OTR because of this fact. Maybe it's time to use the same thinking on the other end of the spectrum?

Now please don't take this as an attack on older people. As I write this I think about how I will still need to be earning money when I reach that age. So maybe in hindsight as you get into a graduated age group you should be required to be tested every year or 6 months to keep your CDL.
