Independent Contractor Status: The Good, the Bad and the Ugly

There's both good news and bad news in the trucking industry's ongoing battle to preserve the independent contractor status of its owner-operators.

At attorney specializing in these issues says there have been some recent, significant court cases that appear to be good news for the trucking industry. But a bill in Congress could spell trouble.

Greg Feary, partner, Scopelitis, Garvin, Light, Hanson & Feary, works with the American Trucking Associations to track and provide counsel on these issues. He spoke on the topic to the Truckload Carriers Association's Independent Contractor Division last week.

The key issue in the court cases Feary cited involve the issue of the amount of "control" a company has over its independent contractors. In the past, factors such as requiring uniforms, satellite tracking/communications systems, and even federal safety requirements requiring a certain amount of control over an owner-operator in the past have been used to attack independent contractor status. But Feary says he sees a trend of the courts moving away from the "control" factor as a way to determine independent contractor status.

I have never worked for a company that required me to wear a monkey suit, even as a company driver. Jeans, a shirt with an inoffensive logo, and either sneakers or work boots are good enough for me. If I wanted to wear a uniform, I would be working at a fast food joint or in an office complex.

my boss provides us with t-shirts to wear....and because I ruin cloths loading, I proudly wear mine.

My company provides us with a uniform shirt, uniform pants and a $150.00 yearly boot allowance. 11 sets plus they have a service that washes them. While some drivers would never want to wear such items, I find it totally acceptable. It really makes a difference in the eyes of a shipper/receiver. Not to mention the public and and other drivers. There were so many times that a driver came into our shipping office in tattered, stained, smelly and just plain unprofessional attire. Quite a few of them stank to high heaven. How do they live like that? Anyway, I think uniforms give those who wear them a sence of pride and professionalism.

There comparing a cook to an IC oh boy. And make changes to make more sence like a IC can sell the routes, wow there really clueless. What company would let you sell there contracted customers anyway. How about having open bids on senate seats. hehe

V8 just ask the Former Gov of IL what happens when you do that. Last I heard he was looking at 300 YEARS in the FED PEN and 4 million in Fines. Oh and he can not run for any ELECTED OFFICE in the state of IL for as long as he lives or be appointed to one also. He can not even be on a School Board.

With NO BAG LIMIT would be NICE here in IL. That way we can CLEAN HOUSE. Better include the IDIOTS in the so called House of Reps also. That way we can get RID OF THEM ALL.
