Drug Consortium law ??????

Anyone know of any changes coming down the pipe ?? Additional paperwork, drug testing related, etc.

Have there been any post I have missed?

I ask because a friend who runs 2 Class A trucks in his business (non-trucking) requested information from the DOT this week. And got a personal visit from MDOT.

The officer stated, had he waited 2 more months when new rules go in effect. He would have had to fine him, rather than just educate him on the laws and regulations.

He parked both trucks, and has put them up for sale. Says he can contract his equipment moves, cheaper than he can pay part time help and keep up with DOT paperwork requirements. . His drivers are still employed doing other duties outside their previous driving duties. They only drove about 20 hours a month to begin with.

Actually....No. He would have been out of compliance by mid December, according to the officer. And the new rules require a fine to be levied upon discovery.

Compliance of what ?? Is what I'm having trouble getting a handle on.

All I'm sure of, it's drug testing related.

Yeah, I think that'd be a pretty important thing to know about. Your friend didn't have any further information? Did the DOT guy tell him anything?

I am going to go out on a limb here.

I think it may have something to do with the part time status of the drivers and drug testing requirements. If they are not in a pool it is a problem. There might be new rules about the processing for part timers as well.

I looked, but did not find any info on it.

I think I'm going to have to get back with him on it, for clarification.

To the best of my knowledge, he's talking about the required drug testing and reporting regs, of a CDL holder/employer.

He made it sound like there was more. It was the fine that got my attention. I'm wondering what is new that would require a fine to become mandatory in December, where a educational/instructional visit was done in the past.

The states all being broke and needing to steal more money to cover their blatant mismanagement comes to mind.

20 or 30 years. But he has only used a Class 8 for the past 5 years as his equipment got heavier. Up until last year, all his moves have been intrastate.

His is/was a private carrier set up and only hauled his equipment from site to site. Two of his regular employees obtained CDL's for this. The trucks only move when the equipment is relocated.

We're talking maybe 40 moves annually, none taking more than 15 hours max.

Actually, he's not concerned with the issue. He's going to contract it out.

I'm the one wondering what has changed in the law....for my own peace of mind.

No changes that I know of.

You said he recently changed from intrastate to interstate. That would mean he went from the state rules to the federal rules.
