I've read thru many of the "Let's go on Strike" threads and they all come down to a common theme. How to get truckers to agree on anything.

    This is my thought.

    Companies start the Strike.
Think about this, what if the company you worked for or are leased on to, tells you that on "this date" you will park your truck and not haul anymore freight. They say they will pay you X% of your daily/weekly income for as long as the work stoppage last. What would you, as a driver do?

I'm sure there are small company owners on the forums, or folks that work for larger companies that cruise the forums, tell me what you think about this. I don't believe it would ever happen, but, it's food for thought.

Note, I'm just a company driver, not an O/O or lease driver, and I really don't see my company doing anything like this.

Why would a company pay you not to work? Me thinks you have out thought yourself.

I've heard of a couple of small fleet operators and small company owners that have said that they would shut down their trucks in support of a work stoppage(can't say strike because owner/ops & companies can't strike under federal law).

But asking to pay the drivers, .....well prob not, and if you keep talking like that someone is prob going to ask you to pee in a cup because that kind of thinking would be classed as reasonable cause suspision

Explain please. I know that police and fire can't strike and that public transportation unions can't go on strike, but never heard that trucking companies can't go on strike.

And the pay thing was stretching it a little, but if you get even 3 of the major companies, like Swift, Prime, Schnieder and a couple smaller companies to do a "work stoppage", what kind of damage would it do to everything and do you think that other companies would fall in line?

Or would the other companies be like vultures and start taking contracts.

I think some have missed or have not mentioned on little dirty secret in the trucking business.

The LARGE COMPANIES ARE ALL THE SAME COMPANIES WITH DIFFERENT COLORED TRUCKS.

What do I mean by this??? lease on with any of them and you will see what I mean.. they all pay the same rate, offer the same plans, same deductions ,maybe a twist here and there to not look conspicuous.

The swifts, knights, hunts, us express et all, who have their own brokers working on their nickels, have the rates set to what they can make a profit with.

The shippers, outside brokers, trucking companies all know up front without even having to ask, what these big companies will and will not haul loads for.

The kickbacks, the out right payoffs, and private jet golfing vactions that the swifts of the world put on with major ceos from the big companies, like nabisco, gillette, heinz, et all have no problem at all meeting on the greens at the tiger woods golf course in hawaii a couple of times a year and laughing at how stupid we are for hauling such cheap loads everyday, making them billionaires.

That My 2 cents and thank you for the opportunity to do so, in whats a free country for at least a while longer.

The answer to your question is that Owner operators are classified as independent from the company and are actually an entity onto their own.

If I take my "company" and you take your "company" and we decide to shut down and refuse to work we can be charged with collusion. We are colluding to use our assets to unfairly get what we want(I don't see what's really unfair with it.......the oil companies do it every day.)

I believe we can can also be charged with racketeering or "price fixing".

I will stay "home" or make sure my HOS reset falls on that day to be sure Iam compliant with the laws at hand. I am a broker and have no issue with supporting any "shutdown",for me it's just a day to kick back and relax, regardless of where I am.
