BELLEFONTE — A hearing is scheduled for Friday on a defense motion to throw out a medical test that police said showed a Vermont truck driver was high on methamphetamines at the time of a fiery crash that killed a Hollidaysburg motorist.
But Peter Carrara, through his attorney, says the blood test that police cited as evidence to support charges of homicide by vehicle while DUI, homicide by vehicle, DUI and involuntary manslaughter doesn’t exist.
Carrara, 55, of North Clarendon, Vt., was driving on state Route 64 in Walker Township in May when his truck crashed into an Oldsmobile sedan driven by Bonnie Weaver, 57. Passersby were unable to free Weaver from the wreckage of the car before it was consumed by fire.
Court documents filed by police state that Carrara was immediately taken to Mount Nittany Medical Center for a blood test, and state police obtained a search warrant to get the results of the test. The blood tested positive for methamphetamines and amphetamines, police said in court documents.
Except it wasn’t a blood test, said Carrara’s attorney, Brian Manchester.
“There was no blood sample taken from Defendant at all,” Manchester wrote in a motion asking for laboratory results to be suppressed.
