Appeals court revives Michigan man's claim of emotional harm

WAUSAU, Wis. - A Wisconsin appeals court has revived a Michigan trucker's claim that he was emotionally harmed by witnessing a fatal traffic accident.

Gale Schaffer of Iron Mountain, Mich., is seeking damages for emotional distress after a car skidded on a snow-slick road in Marinette County in 2005 and smashed into his truck. The accident killed the 21-year-old driver of the car.

Schaffer sought damages for emotional distress, among other things, from the victim's insurance company but a judge dismissed that claim.

The 3rd District Court of Appeals on Tuesday ruled the judge wrongly determined Schaffer had to fear for his own safety for the claim to continue. The panel says that standard applies to bystanders and Schaffer was a direct participant.

Schaffer claims he now is paranoid about driving.

turn about is fair play. 4-wheelers hit truckers with BS suits, we should be allowed to smack 'em back.

I'll say it's a BS suit. Accidents happen and wanting money because someone "harmed your emotions" is absolutely ridiculous, much like the people that sue because coffee is too hot, or those that sue because they slipped and fell.

No worries, though. These insurance companies are actually backed by companies overseas who see a fair return on investment. Many of the insurance companies may be backed by the same company. The money this trucker could get won't be coming out of the insurance company's pocket, the insurance companies make money one way or another. I doubt the guy that hit him has paid in what the driver may be asking for in "emotional harm". The money he gets will be from you and me paying our insurance bills.
