This is incredibly sad for all concerned. I once had a driver blow a tire and come across the interstate median right at me. Yes, our eyes locked and he was screaming and by a mere 4" at best, we avoided each other. THANK GOD.

Recourse for the Driver
As to the question of what happens to the Driver after an accident like this, depending on the State where this occured, or, where the Driver was domiciled, there may be Workers' Compensation benefits payable for the true mental anguish. Something that should be looked in to.

Workmen's compensation is very restrictive on these types of claims. It is also possible, that the driver was an owner operator and may not have such insurance at all.
