N.J. trucker will not face additional charge from April crash

BENNINGTON — A New Jersey trucker will not face additional charges from an April crash on Route 9, despite the recent death of another victim.

Bennington County State's Attorney Erica Marthage said Kenneth Middlebusher, 42, would not be charged further, as state legislation did not allow for additional charges on multiple deaths until after the crash occurred.
"The way it was written before, where there were multiple deaths from one accident, the Supreme Court said you could only charge one count of gross negligent operation," Marthage said. "The legislature recently changed that." Marthage said the change came in July, almost three months after the crash. She said, though, the new death would likely have an effect on sentencing.
