Driver is certainly going to have to learn to live with some guilt. I wonder if the driver was an employee or one of the trainees. I would assume was an England employee? wonder if he had a bus endorsement?

Good question, because if the driver was an England employee, and instructed those students into that van I would say it's a pretty iron clad case. However, if the van is just there for students to use, and they all piled in, under their own discretion, I think you have quite a gray area? -
I don't see how England can let "non employees" operate a company vehicle, even if they are self-insured but with England, I wouldn't put anything past them.

The news article said they came up to slowed down traffic, and it sounds like the driver had to swerve to the right to avoid the traffic or pile into it. It is a bad situation, esp when the people didn't have seatbelts on.
RIP and a speedy recovery for those hurt. -
Bet dollars to donuts the brakes on that van were well past needing to be replaced, then factor in the other probable factors that I won't mention. Just another matter for CRE legal to make go away for the least amount of settlement as possible. Don't you know they are a busy bunch of people.

Update: other news outlets are reporting only 10 passengers in the van, not the 15 LA Times initially reported. I've updated my post on the TruckersReport blog to reflect that.

Wonder if this is the worst accident in Englands history.I'll be curious to know what caused the driver to veer off the road..It is a horrible way for the students to start out their carreer.One lost his life.Sad story.

According to a few posters to the original article, several of the seat belts were out of commission. CRE's lawyers will be busy with this one. Frankly, I wish it would cause the company to fold.

He came on slowed traffic and had to veer to the right where he skidded through the slow lane, hit a tree and then rolled and landed up 15ft below in the drainage ditch. Either the traffic suddenly stopped, or he wasn't paying attention since it was near an exit ramp.
It is really hard to tell I think when traffic is slowed or crawling along I think, until you are right up on it sometimes. I think cars should use the caution lights when this occurs, just to be more noticeable to traffic coming up on them.
