    Point blank...this driver was reckless in his driving habit which in turn caused a fatality and several injuries...I don't feel pitty for him whatsoever...he's going to get what he deserves...

    Walmart's del schedules are so lax that they have plenty of time to del the loads to stores on time...this knucklehead just tried to be dumb about it and now hopefully he's done as a cmv driver for good.

    So what we have learned here is A. Elogs don't stop crashes B. Speeding in a construction zone is illegal and dangerous and C. Bad apples are the problem, not all the rules that actually do nothing but hurt the people who are actually safe.You can pass as many laws as you want make as many restrictions as you want . You will still have those drivers that are unsafe and cause problems.

    Yes, and add to that the issue that many states/cities make it illegal to keep the truck comfortable (no idiling) so the driver can get proper rest, like the rest of the country.

    Weather or not we agree on this Tom--there are certain things in play that cannot be ignored--and IMHO--the biggest factor here is WalMarts corporate actions after the Maine incident--
    The bottom line is WALMART is a retailer--not a trucking company--and PR and PRESS is very very important to them--which is why corporate jumped on the safety bandwagon quicker than Public Citizen the Railroads and everyone else involved---
    Walmart had the PR machine in overdrive by the following day--Corporate beat Claybrook and Nader to the Senate hearings on truck safety--WHY? Because WalMart called for it--Do I blame them for their response--Of course not, I'm not a naive newbie--Again they are NOT a trucking company---they are a retailer who happens to have a private fleet....BUT in keeping up their Public Imagine They sold the government a bill of goods and in turn started the largest/longest legal wrangle in governmental regulatory history that we are still in the midst of.......
    and with their deep pockets along with the railroads (backing Public Citizen)they Created PATT--and of course put one of the kids(killed in 93)Moms in charge...Brillant PR moves for Wallyworld--no doubt....
    Then came the TV campaigne w/Wally World trucks helping stranded motorist--backed strongly 3x a day buying up almost EVERY available second of air time on Paul Harvey.....Next the TV ads of how WALMART opens all of its retail centers to the PROFESSIONAL DRIVERS OF AMERICA--telling the wordl--the reason there are trucks in the pkg lot is because WALLMART believes in helping keep the AMERICAN PUBLIC SAFE(ie their customers)and allows truckers to safely park at any of their locations for the required rest THEY NEED...
    So believe it or don't--I GET IT--I don't like it--I know they are full of ####---it's a Brilliant PR Campaign---but any of us out here know they are full of ####...and had it not been a walmart driver in 93--it would've just been another unfortunate accident--the Maine DOT would have went nuts for a few months and that would have been the end of it......and just like if this wasn't a celeb...and it wasn't WalMart--this whole thing would have been a local Central Jersey event--2 weeks old and long over--just like the precious little girl killed only yesterday by a tri-axle outside philly--shame it sucks but true....
    BUT the one thing you can bet YOUR ### on is--we are #### sure gonna get another absurd PR Campaign out of this one---Your corporate PR machine will be back in DC again with the rest of the safety Nazi's-and ALL over the airwaves-throwin the rest of us under the ####### BUS!
    meanwhile they'll tightem y'alls dispatches up a lil---keep farmin out the real tough stuff to the Mega's who back y'all up at the DC's--who of course THEY are not responsible for.........
    I've been at this quite a bit longer than almost all yall combined--and Im not going anywhere anytime soon...So while I do not fault you in the least for backing up YOUR employer and touting your safety record.....I'm not drinking the corporate Kool-Aid.....and Ill go ya one better--let's discuss the situation 18months from now and see how your boys and girls in bentonville play this one out--and If Im less than 90% spot on--Ill buy--you and your entire family the best meal in your favorite place--wherever it is y'all call home...

    it will be a bit interesting when they get the ecm report on the sprinter limosine as well, it would make it very interesting if the limo was doing 75 just before and cut to the middle lane in front of the walmart and jammed the brakes, might be a game changer, would it also not be a hoot if the limo driver doesn't have the proper credentials to drive the limo.

    it is just odd that no one seems to think anything occurred but the walmart driver was completely at fault. most of the posters have the same mentality of jumping on the big guy that is Wal-Mart.

    no one seems to think that in an instant you could be in the same shoes as the Wal-Mart driver,

    have any of you ever had a vehicle cut you off and ram the brakes to where you had to swerve to avoid them??

    Every driver should practice it! Smith System:

    1. Aim High in Steering
    Look 15 seconds into your future. (Don’t just look at the vehicle in front of you)

    2. Get the Big Picture
    Look for Hazards. (Other Motorists, Pedestrians, Vehicle doors opening)

    3. Keep Your Eyes Moving
    Don’t stare. (Use your peripheral vision)(Stop the fixed habit stare)

    4. Leave Yourself an Out
    Monitor the space cushion around you and your truck.

    5. Make sure They See You
    Use your signals- (Directionals, 4-Way Flashers, Head Lights, Brake Lights, Horn, Hand Signals) Make Eye Contact.


    Walmart driver definitely did not do #1 or #2. Even if he was tired and speeding, had he been following the Smith System at the time he may have prevented this unfortunate "accident".

    The Walmart driver was doing 65 (speeding) in a CONSTRUCTION ZONE and failed to stop in time, bottom line. Whatever scenario you come up with, had he been doing a safe speed for the conditions he would have/could have stopped and prevented this.

    Not true. But the facts are in and very few are defending him, like yourself, because he WAS at fault for speeding! Period.

    Yes, but I didn't swerve. But you are bringing up scenarios which did not happen in this case according to the preliminary report. If in fact it is proven later on, then it's fine to make this point. Until then your point is simply conjecture.
