TRENTON, N.J. Tracy Morgan has sued Walmart over last month's highway crash that seriously injured him and killed a fellow comedian.
The lawsuit, filed Thursday in U.S. District Court in New Jersey, claims Walmart was negligent when a driver of one of its tractor-trailers rammed into Morgan's limousine van. The complaint claims the retail giant should have known the driver had been awake for over 24 hours, and that his commute of 700 miles from his home in Georgia to work in Delaware was "unreasonable." It also alleges the driver fell asleep at the wheel.

the problem is that the walmart driver had not just driven from his home in ga. he was in fact on his second 14 hour driving shift . he had working one 14 hour deal taken his ten hour break and was on his second 11 hour driving shift. he had 30 minutes left to drive. logbook was completely legal.
this was stated in a preliminary ntsb report. I am waiting for the results of the ecm on the limo. how fast was he going ? did he cut in front of the truck at last second from the right lane? -
Since when is it the job of the civil court system to determine a "reasonable" commute? Is my company now supposed to send sleep checks on my Qualcomm so I can confirm I'm really sleeping?

700 miles in a day isn't unreasonable if it can be done within the 11/14.

All Wal Mart is going to do is settle the lawsuit out
of court. They dont want the publicity of a trial.
Then they will raise the price of all of the merchandise they sell by a few cents and pass

I'm not sure the extent of his injuries, but I would imagine this could be settled for a huge amount of money if say he no longer has a face and is unable to work, with the exception of the odd low budget horror fluck.
