This may sound harsh. Some people go through life without a thought/care of how their actions/decisions effect others. For whatever reason. At some point it may come back around and then you're dealing with your own poor decision making and sometimes it's your last one.

As far as inspection, if they found any defects that weren't noted by the driver that would put the truck/trailer out of service, that same "shouldn't be here at this place and time" conclusion would be drawn. The truck driver was a pretty old fella in a 14 year old Volvo. Curious situation...NavigatorWife and One_tooth_wonder Thank this. -

They pulled this crap after I was hit head-on by a distracted driver last week. I was in the ambulance about to go to the hospital and get checked out when DoT opens up the back door and starts asking where my logs are. ELogs, I tell him, and she hit the battery and disconnected it. Then he tells me he has to inspect the truck and trailer. I thought for sure I'd come back to a ticket, considering my luck. They must really be hurting for money.

Several contributing factors will be considered in the investigation. Had he falsified his logs to get to the point where he broke down? If so, maybe being tired caused a lapse in judgement, he could have pulled off at the last offramp before the truck would not roll anymore... Did he have an opportunity to have the truck towed but chose to sit there until his buddy brought him a part from 500 miles away? If so, he is partially liable because he used an "emergency lane" as a parking spot for 48 hours.
Lawyers can take any piece of an investigation and turn it into the truck drivers fault.
So yeah, the truck does need to be inspected.... And that driver needs a Lawyer. -
