Lawsuit concludes from truck vs. Amtrak train crash in Nevada.

The NTSB accident report is pretty damning. Be sure to check out the animation. Seems like the driver was trying to outrun the train and started braking way too late. The company also didn't do any due diligence in hiring. The guy had 30 jobs in 10 years, multiple moving violations, and four suspensions.



"The investigation revealed that nine of the 16 brakes on the truck were either out-of-adjustment or inoperative. In addition, the antilock brake systems of both trailers were not functional. Wires to missing sensors were cut and zip-tied and wires to malfunction indicator lights had been disconnected, raising serious questions about the maintenance practices of the trucking company, NTSB said."

 

Chain of events. If any link in that chain was broken, this would not have happened.

 

So does John Davis Trucking have footage of the incident? They claim "the system that would have warned the trucker about the oncoming train was not working properly." Do they have proof?

I haven't crossed it since before the accident, but as short as Amtrak trains are and their color scheme, I could see the possibility of not seeing the train itself. As far as the markings and crossing itself, I had always considered it a higher risk than most because you do not have a good line of sight on the tracks until you are really close. Personally, I would like to see the highway segment redone to reflect the model used on CA-58 west of US 395 (4 corners, Boron, Kramer's Junction, pick your name) where the highway runs parallel to the tracks for a distance before crossing and the parallel again so both directions of travel have a good view of the tracks.

 

We the taxpayer spent money on this "study". The conclusions they came to and the recommendations they came up with have ALL BEEN STANDARD FOR YEARS!

They recommend a mandatory work history investigation going back 10 years (that became law 20 years ago) they recommend a database for CDL holders so perspective employers can see work history (thats called a DAC report, been around for years)...
