Has WalMart sunk to a new low?

Standard legal posturing and strategy. Lets not be so naive or shocked as it happens every day. It is Walmart's lawyers job to represent their interests and to prevent massive losses. If you were the truck driver in this case you would want them to the exact same thing to try to save your ### and lively hood. Why plead guilty? Get your day in court, who knows what may happen.

First, I think this driver is 100% guilty, should see jail time, and never see the inside of a truck again. That is my opinion. That being said, this is America, and everyone has a right to plead not guilty and have their day in court.

As far as Walmart goes, GOOD FOR THEM! We've been hearing for weeks from TM's lawyers that they are going to sue WM big time and to 'teach them a lesson'. I have a feeling WM's initial remarks meant they were ready to pull out the checkbook and settle this quickly. IMO TM got greedy and was trying to use public opinion of WM to get a bigger sum. Now WM is showing its teeth. I don't harbor much love for WM in general, but the way TM's lawyers are spinning this, I think this is one time I'm going to root for them.

 

Funny thing is that if it said the BUZZLE WUZZLE PUZZLE COMPANY on the truck and trailer it likely would not get a mention but oh my god it says WALMART.

And you can all be sure if it was your truck and trailer involved you would want your DEFENCE ATTORNEY to plant the seed of thought in the mind of a jury that quite possibly the actions or in this case NON ACTIONS ( failed to put on seat belts ) contributed to some point in the injuries and death of the occupants when it came to how much $ you were going to paying out.

 

and they are not denying any wrong doing just saying the injuries may have of been less if the passengers had been buckled up. It is nj law that all limos and buses are equipped with seat belts so it may sway the outcome just a little.

thanks flatbed good to see someone with some common sense...... these accidents are happening now weekly it seems like. every time you listen to the news another truck wreck with fatality. what about the driver a few days ago hit a bus killed four young ladies? It wasn't walmart so it will die out quick.

and 700 cdl drivers die every year behind the wheel higher number then any other profession.....

 

I work for that company involved, and no it will not die out quickly.. It just started and there is plenty left to do, to close this case.. The local press will be on it on a regular bases... Up until now, we did not hear about this Wal-Mart case, since it happened..

 

NJ Law is very Clear on the Seat Belt issue. All Passengers Front and REAR are Required to use SEAT BELTS at all times when a Vehicle is in Motion in the State of NJ. Also remember that regardless of What that Driver did BEFORE he logged in for work he was OFF DUTY and Not Subject to FMCSA Regulations. Until that part is Changed by the Feds nothing that He did was ILLEGAL prior to his coming on duty for Walmart. So even if he had done what I did a few times when I drove aka drive from Goldsboro NC to Streator IL the Day before I left there is Nothing that Tracy's Atty's or Walmart's Safety Dept can do with it. BTW that distance is 896 miles and 14.5 hours of time straight. So I would have been more Tired than this guy and I still did 10 more hours BTW the next day.

 

Walmart nor ant other company has control of drivers action when on personal time. Walmart should only be held accountible for violation after the driver came to work. As far as the seatbelt it has to due with contributing to the severity of the injuries, not the accident itself.

 

are you sure about that statistic?..seems I read somewhere that TrDriving was top 10 of the most dangerous jobs..don't think it was #1?

More deaths(many many)more than any other of the "most dangerous" jobs..
