    a passenger of a vehicle is the drivers responsibility- if the passenger refuses to wear a seatbelt while seated in a moving vehicle it is still that drivers responsibility. if tracy s injuries are caused in part by the fact that he wasnt (correctly) wearing a seatbelt at the time of the accident, when others in the car were and suffered less injuries- walmart indeed does have a valid legal point of defense.imo

    Where did the accident take place? What are their laws concerning seat belts in limousines/passenger vehicles? I wish I had some free time to look into that. IF there is NO law stating you MUST wear a seat belt in a limousine/passenger vehicle this statement would be very much like saying, "that person shouldn't have had their shoes untied when I hit them in the crosswalk.".

    That's what you do as a defendant in a case. What did you expect the defense team (Walmart) to do, roll over and show their belly?

    That's not going to fly very far. The occupants of Morgan's limo weren't operating the semi that plowed into them. They didn't speed through a construction zone. You could go as far as to claim they were drunk/stoned/fatigued/otherwise distracted and it still wouldn't matter. They weren't behind the wheel. I could see a potential site against the limo operator if there are passenger seat belt laws in place for limos and busses, but that has nothing to do with the truck.

    Hi Criminey, apparently, limo's are exempt from seatbelt use. The fact that the driver is claiming he's innocent is just craziness. I mean, it doesn't get any clearer than this. He fell asleep and plowed into the back of the limo. I almost spit my coffee out when I heard this.

    This is the legal system at work. Even if a person is caught in the act of shooting someone by the police...that person pleads 'not guilty'. Strange thing is, I remember right after this accident occurred, Walmart publicly proclaimed that they would do the right thing if they or their driver were found at fault. Even though the driver hasn't been tried in a court of law yet, the evidence all points to it being his fault...Walmart...I wonder if I walk out with a brand new 70" OLED flat screen without paying for it...and I claim I am innocent...if they will let me get away with it.
