    Investigators will "collect" anything they find laying around following an property damage accident, let alone a fatality accident. Then the attorneys will subpoena the devices and records themselves, as well. (cell phone, engine recording, any in-cab data device such as , EZpass, eLog or EOBR, iPod, or eLog device bought at a truck stop, whatever.

    If they can collect blood, they can collect anything. You can say they need a warrant and try and hold on to these things as long as you want, but your'e wasting your time and further incriminating yourself come pre-trial time.

    I was stuck in that traffic jam. Im not sure how the driver accomplished what he did, but what a jacka**!!!
    Took me 3 hours to go 55 miles. The truck was hauling produce.

    I swear that section of road is jinxed. I drove it for business a couple times a month for several years. It was a safe bet every time that a big truck would be in the ditch between PHX and Tucson. Clear skys, straight and dry road, but there was always a rig in the ditch. Never could figure out why.

    Exactly my point! 99% of the time there is no reason! Nice straight dry and dusty road.

    Sure does seem to me like you are jumping to conclusions before knowing what happened here. No it may be that driver was totally at fault. And if so, I agree he should be prosecuted. But we don't know that, at least from what we have been able to see here.

    So I sort of have to agree with you, when you say you don't know anything. And until we see further information, this may will be that 1% of the time you are talking about.

    Folks who know my posts, know that I am not one to make excuses for a driver screwing up. But I really do hate it when other drivers jump on the "guilty until proven innocent" band wagon. No matter what happened, this driver will be living with the fact that he was involved in a fatal crash, and he will live with it for the rest of his life.

    Again, if he screwed up, "hang him high." But if he did NOT screw up, then he is just as much a victim as anyone else. I know that the investigation is likely to prove that he DID. But let's wait and see, before we lynch him.
