I say driver preventable. They got us boxed into a real tough new standard and whether the new standard is right or wrong; it is what it is and under the new standard this one counts as driver preventable. Too many (to use current jargon) "WTF are you up to's" going on here on the part of the p/u for me as a driver to not take it off cruise and slow a different "WTF" - down and try and figure out, "WTF", on a rural highway w/ a guy that passed me in a p/u now pulled over at an intersection, at an odd angle, in the middle of nowhere. What's he gonna do is always on my mind; even though I'd rather it be the one that got away in my life that old Willie Nelson sang about, that's always on my mind.

Nobody got hurt. That's the main thing.

Maybe I'm just too suspicious and untrusting of the other guy, but alarm bells were going off when he blew by me, then I saw him stopped on up ahead of me at a rural intersection in BF nowhere. I'da backed way off and assessed as I approached. That's just me though. Not slammin' him or takin' up for the other guy or tryin' to arm-chair quarterback.

Just sayin'; them new standards has to give us longer eyes and moments of pause. Lest they hang us with our own rope.
