    Terribly tragic. I fear that the investigation will find out that the driver was self distracted, texting, fiddling with the radio. A bad day for all of us My condolences to the families of all who were lost.

    So the driver (who was immediately and primarily responsible for the operation of the truck) isn't being named because he's not been criminally charged...but the company which hired him to drive, and the company that owns the company he drives for are both named as responsible parties.

    To me, that screams "we're looking for money...lots and lots of money" and they know the driver probably doesn't have enough of it to make it worth the effort to take. Hell, the driver would probably go into debt defending himself in the suit and wouldn't have a dime to his name by the time the judgment was handed down, so they'd never see a penny of the awarded amount.

    It's all about the money. They can claim it isn't all they want, but it doesn't change the fact that the person who screwed up isn't named in the suit while all of the deep pocketed corporations HAVE been named.

    Sad for all. The driver may not be able to drive after that. Nightmares, sleepless nights/days.

    So if someone in your family was killed by a truck plowing into slowed down traffic you wouldn't sue the company he was driving for?
    I don't know what caused this accident but just because he hasn't been charged yet dose not mean he has been cleared of causing
    this accident yet. Five young women where killed and quite a few more where injured. I guarantee more lawsuits will be filed soon.

    I'm not saying the lawyers wouldn't be involved...just that I find it odd that the 1 person who was at the controls of the vehicle that caused the crash is NOT being sued...but the company he works for, and the company that owns the company he works for ARE BOTH named in the suit. If it had happened to somebody in my family, you #### well better believe the driver would be the FIRST named party in the suit, followed by his employer who hired him and the motor carrier with the operating authority. The only reason to include the parent company (deep pockets) and NOT the driver (probably broke) is money.

    Just think about how fast after the wreck and already had time to see a lawyer and get papers filed. Where was any time to mourn her daughter?
    And don't get me wrong I am sure in the end I would do the same but weeks after. Would take me that long to really function if i just buried of one of my girls.
    To me it lacks compassion!
    All around its tragic and I feel for all those left behind and involved.

    I see that the article about this lawsuit was posted on a Chattanooga TN, Newspaper website which is where US XPRESS has it's corporate headquarters.
    I would be pretty certain the Attorney they hired to file this lawsuit specializes in truck accidents and must have his reasons for filing the suit like he did.
    And why not go after the company with the deep pockets? What's the point of suing if not for the money? It won't bring back their deceased daughter but
    it sure is going to cause a lot of headaches and sleepless nights for the people that own these trucking companies. More then a few of them will be looking
    for another job before it's all over. They are both well known bottom feeder companies, I hope they pay through the nose before its all said and done.
