does this qualify for unemployment?

    I recently got a otr job running from ord to mia and back, All air frieght. I got this after 2 years local p/d in chicago. I went out with another driver out of miami to see exactly how everything is done and where the deliveryies go. I find out that the drive can be done in 24hrs with one driver. 1. 11 hr. 2. 10 hr. 3. 11 hr. might get you close enough but it leaves no time to make the 1-3 deliveries let alone the 1-2 p/u for the return all of which are time sensitive for outbound flights. he says it's all local for him so it does not count since he lives there [maybe he can get away with it]
    when i do the run on my own I find out I can not do it but I get it done. Get put up in a motel with hookers outside at night.
    After I come back for one day they want me to make another run with 4 hours notice and I refused because of the H.O.S. rules and I would not break that to make deliveries when I should be down. I have a perfect record going back to 75 when I got my license.
    So my question is " IF" I lose this job for refuseing the run can I get unemployment which I was on for 6 months prior to this job for refuseing to break the law and drive when I should be stopped.​

    i've read the IL dept. of employment security site and it doesn't really say much other than don't quit. if you're "discharged for misconduct" you could be disqualified, but it would be hard for the co. to justify to the state firing you for not wanting to run illegally. have you tried calling the dept.?

    make sure you keep records of what's happening just in case.

    First off, how many miles are you driving away from the main terminal? Short haul delivery drivers (Maine law is 150 miles from central terminal) for any of the major bottler companies, are allowed to drive upto the 14 hour window. As long as you dont exceed state requirements for distance from terminal, the company can require you to drive up to that 14 hours.

    Second off your talking of only having driven 11, 10, 11 hours of driving and your complaining about getting a load notice after 4 hours? Just what kind of business did you think trucking was? We are not a 40 hour week. Most companies will work you at least 70 hours per week. If you need a holiday after only 32 hours, your in the wrong business.

    chicago to miami 1420 miles. In two 11 hrs and the 10 gets you close to miami, but not the 3-4 hrs need to make the deliveies. In trying several mapping sites it's 22 to 24 hrs driving only. In practical time and miles the shortage is the distance from atlanta north to tenn. then add in 6 cities of traffic.

    ok, giving destinations changes the post from above. I still see it as a 28.4 hour run. Of which is under 3 days. On day 3 you would be starting with 22 hours driven, thus giving you 6.4 hours more to drive and 7.6 hours of delivery. Of this you think your going to run out of time?

    as the first post states, 1, 11 run 1, 10 hr break 1, 11 run is all the time given to drive from ord to mia AND make deliveries and pickups. A second 10 hr break is needed then a 3rd 11 drive time to be legal but that amount of time is not given as the deliveries are time critical to make outbound flights.

    an example of a run , leave ord at 6-9 pm on monday night. appoinment for delivery is wed. 8 am. that is 35 to 38 hrs. total. 11+10+11 = 32 hrs log time. another 10 & 11 is needed.

    Not sure how it works in your state, but here you have to be employed for at least 6 months before your eligible to draw unemployment. I think you'd actually have to draw on your old employer.

    What does this mean ? "I cannot do it but I get it done ? " Right there it sounds like you willingly violated HOS . They can use that for an excuse for terminating you and to say you don't qualify for unemployment .
    This is why the logic "any job is better than no job " doesn't work .
    Too many people go to bottom feeders only to get abused and end up jobless again in worse shape than they were before .
