Off duty in a daycab.......

    In your opinion, or based on actual citings of existing regulations, can any part of your body be physically in a daycab AND you still be legally off duty, line 1?

    i give my reasons for asking this question later...........or maybe i wont.

    Not true at all, engine has to be off, you can not be in the driver seat, you have to have a off duty card issued by your employer. Truck has to be parked in a safe place, not on the shoulder of the road, but an actual parking lot, truckstop, Grocery Store, etc....

    I worked for Apex Bulk in the 90's and we went off duty with day cabs all the time. Now as far as taking (then it was 8 hour) your 10, it was motel time.

    Line 2 cannot be done in a Daycab (sleeper cannot be defined by CFR)... but, not sure about line 1... a friendly call to your local DOT would clear it up...

    To go off duty long enough to reset your 14 hours you need to be able to provide an address or documentation. I used to pull loads from Tehachapi, CA to Phoenix. AZ in a daycab, I used to list the address of a friend I stayed with in Phx on the log book page where I flagged the 8 hours off duty or the Motel and address. The Motel required a receipt. I never had them question the address of the freinds house, But I did have them ask for Motel receipts. Banning Scale used to have a fondness for daycabs running west.

    What Is On-Duty Time?





    All time at a plant, terminal, or other facility of a motor carrier or shipper, unless you have been relieved from duty by the motor carrier;
    • All time inspecting or servicing your truck, including fueling it and washing it;
    • All driving time;
    • All other time in a truck unless you are resting in a sleeper berth;
    • All time loading, unloading, supervising, or attending your truck; or handling paperwork for shipments;
    • All time taking care of your truck when it is broken down;
    • All time spent providing a breath, saliva, or urine sample for drug/alcohol testing, including travel to and from the collection site;
    • All time spent doing any other work for a motor carrier, including giving or receiving training and driving a company car; and
    • All time spent doing paid work for anyone who is not a motor carrier, such as a part-time job at a local restaurant.

    What Is Off-Duty Time? In order for time to be considered off duty, you must be relieved of all duty and responsibility for performing work. You must be free to pursue activities of your own choosing and be able to leave the place where your vehicle is parked.

    That's the legal way. There is no rule stating you have to produce a motel receipt or justifying your off time.
    Though some DOT might ask if you were in a motel, you would have a receipt.
    What powder joints does can't be proven wrong unless they go to extent of checking the friend out which they won't do.

    Go ahead and take your nappies in the pickle parks. :)

    Orginal Question was "Can you take Off Duty Time in a Day Cab ?" The answer is still yes. With a Off Duty Card.

    You can print it larger, does not change the fact that a Day cab driver (most carry them) can get a off duty card from there employer. This card enables you to take breaks during the work day and log them as off duty. However, your right I don't know where it's listed. I have been told by CHP DOT officers that in a day cab when taking your breaks you have to be out of the drivers seat, passenger seat was ok during a lunch break. You can not go off duty as far as taking your 8 hour reset, know that may have been his opinion.

    I drove a daycab locally for 7 years before going back to 11 west. While your throwing stones how much daycab experience do you have.

    If you drive a daycab and your showing enough miles causing you to have to take time off in the middle of the round, without return home or to the yard, the scales will ask you for proof of where you took your Off Duty time since you do not have a sleeper. I see no reason to argue with them or you, I've been there and done that. There are CHP and DOT officers here on this board I'm sure they know the answers. If I am telling the true I would invite one of the CHP/DOT/Log r us to correct me.

    I agree with you completely, you can not claim (Line 2) sleeper when you do not have one. We all agree to that I'm sure.
