Wondering if my friend has a case

    He was left in a broke down truck, in 6 inches of snow, the owner of our company we both work for did not help him get home or provide lodging for him while the truck broke down. After one mechanic changed the oil he tried driving it and was pulled over by a DOT officer who told him park it in the next town or he would call the WHY patrol.


    He has not quit the company but they do not call him into work.

    For me they have had me unloading trucks for free saying it was part of my training.. basicly Ive been working 6-7 days a week plus unloading trucks and breaking down pallets for 400 a week minus about 60 of that in taxes NOT counting STATE taxes...

    I was wondering what I should do regarding this.

    Mid Nov I start with a family friend who is letting me drive for their small 14 truck company who won't shaft me..

    I understand paying your dues as a new member of the trucking company however my boss not only starts us with out a pay check for 3 weeks, as in 3 weeks behind pay.

    This is the 2nd week my check has not come on a SAT in the mail and I will have to wait till the next FRI for a re-issue which basicly has me now 1 month behind in pay with 1 week NOT told to me.


    How should I present this to the labor board and does my friend have a case where he should get an attorney?

    now my young friend that is somthing that all compnmy drivers go thrue sooner or later and really your at the mercy of the company just about all of them do it and trhere is little you can do about it , o yeah ive heard of the labor board but ive yet to hear of one doing a truck drive any good and yes if you get an attorney you have a case if you have the time and the money to put into it most do not that how they getaway with that crap it takes money and a lot of it not an easy thing to do and most attorneys when they here truck driver or trucking company the run like a scalded dog, in this business you have to learn to take care ofyourr self if you dont the business wil eat you alive.

    i would sugest you leave what ever company your with and find anothee job they dont get any better once a crook always a crook you don't have a lot of choice eithere find another job or work for nothing and as for me i dont work for free. but i do wish you the best . southrnpride:biggrin_25514:

    Im not working there untill they catch up on the two weeks their behind on my pay. Also two weeks from the first I start with a family friend in his small company.. Only thing that sucks is for first year I will be stuck in 500 mile radious cause of his insurance.

    My friend who graduated school and who I refered to this company has a record that will limit him but I think CR Englang or Covenant will hire him...

    For me covenant was and still is a back up place but I'm 85% sure Ill be working with a family friend for his smaller company.

  6. "Paying your dues" is a saying that is really abused, in my opinion. Sure, we all did things getting into this business that we didn't want to. Most everybody paid their dues in some way to get where they are. I certainly paid mine. Being a 4th generation trucker, though, I had heard enough to watch my back and managed to keep myself from getting totally hosed.

    Paying you dues DOES NOT MEAN you have to let anyone rape you!!


    I think that both of you should put that experience in your mirrors and find a reasonable job. Do you have a case? Probably, but you also need to find a paying job with an honest outfit. I'm all about working, but you should get something out of it, be it pay or a learning experience. Doesn't sound like you're getting either one.

    WHY WHY WHY... Why Indeed.


    I was told in trucking school that if I did not keep every trucking job for at least 6 months that I would seal my fate in the trucking industry..

    I had no idea about the unloading stuff untill I talked to other truckers over the road, wharehouses etc.

    I, in a way have quit but not officialy because I might want to attempt to draw unemployment, however with them being 1 week late on my last paycheck and my current one as well I doubt I'll be going back to work for them.

    When I got out of trucking school I had a leg up on a few others who graduated from my class. I did not graduate thinking I knew enough to be good and needed to find a place that would give me a chance. I had no idea that my first place would be a place that did not use lube.


    So in a nutshell I am going to the labor board today with another former employee and turning in a claim. Then I'm going to turn in my final paperwork to my employer and give them 2 weeks notice ( still debating that )

    Since its ONLY 2 weeks till I start with a family friend I just may turn in notice to them. ONE good thing I learned here with you guys is that I need to type out my notice and have it notarized.


    Really I thought everything was just paying my dues but the last truck I had and its filthy condition ( large chunks of feces under the matress + about 6 various sized full piss jugs stashed all around the cab ) + having to unload and off stack 20 pallets of water from olancha got me to go the dirrection I'm going now.

    Yea it sounds stupid as to why anyone would stay with that company but please consider this, it was my FIRST company and I felt if I quit in a month or two I would never get a job with any other company out there.



    On another note I need to find a WA or OR civil attorney for my friend who wants to look into sueing them for leaving him in a broken down truck for a week and a half in 6 inches of snow with no T checks for money or lodging...

    Well you're mostly right. I did learn how to drive a super 10 ( I like straight 10 better ) but I also learned more about my self than anything. I learned that I can be RAMMED backside at 100 different angles.

    The best times of me honing my driving skills were with out their so called trainers riding with me adding extra stress by yelling and such. I did better with out them than with them.
