What to do if the truck parked along the side of a highway is found to have a unopened case of beer in it. The driver was given a breath test and blew a Zero. The truck was headed up to Michigan. The officer held the truck for 24 hours. To add insult to injury he also had the log book not up to date by a few hours. This was in Missouri (New Madrid). Is there any point in showing up at the court house to hear the :biggrin_25514:judges decision or to represent ones self in court? Is it a clear violation to have a case of beer unopened in the truck without a bill of lading? I would appreciate any sincere advice on this issue. I have been told the fine could be
    very expensive.

    Thanks

The problem I see is that there was beer in the truck. unopened or having alcohol in a cmv is a big no no. Luckily the driver passed the breathalizer...last I knew they can't punish you for future use....just current use while operating. Got dinged on the log book....OOPS.......ain't getting out of that one.

My question to you is this......Why was the driver bringing beer with him in the first place. And....is beer that much cheaper in Missouri than Michigan that it is worth getting a ticket for and having this on the license.

Showing up in court may get the fine reduced and possibly thrown out seeing as how the driver did not have alcohol in him/her. But it will be expensive and I think a lawyer may be necessary to get out of this.........sorry about the bad luck

Next time just store it in the trailer and write "1 Case of Beer" on your bills.

:biggrin_25524:From time to time I will take a few beers to the forklift operators who load / unload me day after day. Kind of a "thank you" tip. I wrap them in a plastic bag, strap them to my flatbed, and away we go.
