When driving my POV with a CDL, is the legal limit .04 or .08 BAC?

    I know you are pretty much screwed with any alcohol at all in your system while driving a truck. But when driving you personal car, what are the rules?

    Can you blow a .07 and still get off scott free?

    or will anything over .04 get you canned?


    I think MD has some bs law about anything over .05 getting any driver into big trouble. even though they say .08 is the legal limit. In MD .05 is the most you can get away scott free with.

    .08 is the higher offense of driving while intoxicated. .07 can get you a driving while impaired in most states. Although I have arrested people that are .00, but can not safely drive a vehicle. The reason, they are impaired by drugs. I've seen people convicted of DWI when .03, because they have drugs on board as well. The .04 comes into play when driving a CMV. The .04 is the CMV DWI. But when driving a CMV you can not have any detectable presence of alcohol.

    ok, but this is what gets me. why do they say the "Legal limit" is .08. When it is still illegal for anyone to drive at .07 or .06? I know it is the lesser offense. But it is still an offense = illegal!

    so even thou i have a CDL, when driving my pick up, a .04 will not get me a dui?

    Just an .04 with no drugs, probably not, UNLESS you are so screwed up at a .04 that the D/A prosecutes you for the lesser offense.

    so what is the threshold for getting off scott free?

    .06?
    .04?

    And i'm talking about a normal driver. not a truck driver.

    .00 :biggrin_255:. If you don't have any alcohol in your system, then you have nothing to worry about, unless you consume drugs.

    well then why don't they tell the public that?
    they make us think that a beer or two won't get you in trouble.

    If you want to do this "zero tolerance" thing, then just tell us the score.

    don't make it a big mystery.

    and i think anything under .08 should be ok. for a car driver.

    i disagree......there may very well be people that cannot handle half a drink, let alone a full glass, and i do not want those idiots on the roads.

    why do YOU keep asking about the legal limits anyway's...?? if you're in trucking school, weren't you told....???

    this all sounds all so familiar with me......like someone wants to drink and get away with it.......

    well anything under .04 the cop will prob not arrest you, just make you stop the truck for 8 hours or so.


    i'm not trying to get away with anything. I just want to know the laws. And no one is telling the the laws about driving a regular car.
    And my trucking school sucks. The only thing that i learned was what i taught myself out of the book.

    i mean i want to be able to legally go to a bar, have 1 beer, then drive home. I think that should be legal. But apparently not.
