Boss forced logbook voilations, then fired me.

    I USED to haul cars. Got out of it. The boss put me in a truck, I went to work. 5 days later he gets onto me about being "slow". He was new to the business and I wasn't. Then he started taking loads before I could get unloaded and get to them, forcing me to falsify my logbook and work longer hours. Then when I didn't make the timeline he blamed it on me.I was working some TERRIBLE long hours...and he was blind to it and just didn't care. He would gaurantee that the cars would be picked up by a certain day then delivered the next..and these were from state to state...a long ways. two time of missing the time deadlines and he fired me. Then, 2 weeks later he disolved the company and put the trucks and trailers up for sale. I even got 2 tickets because of him too, 1 was for parking on an exit ramp shoulder in louisianna (because I was out of hours,and la. had removed the rest area that was still on the mapbook..and la IS NOT trucker friendly..nowhere to park) and 2, incomplete logbook, (I was tired,it was late, figured I'd do it in the morning). He was suppossed to "get them off the record" or keep them from getting on the record, Meaning hire an attorney. he even took my whole last paycheck to do that...then come to find out all he did was pay the tickets!! So, 2 weeks later, on the way back through his area, he had me stop by the office...then terminated the employment and drove the truck himself on to the delivery.
    So...just wondering...#1 is there anyway to collect the money he never paid me, and 2 how can I now get him in trouble with the DOT people. I didn't keep any of the 1st set of logbooks. Just the copies of the ones I rewrote. I need some leagl help or advice here and now I am unemployeed and can't really afford an attorney to fight this deal. Sure need some advice here ya'll.

    The boss cannot force you to do so,........

    To answer you question I doubt you'll ever get payed and since your the one that falsified your logbook your responsible in the dot's eyes,.......

    I USED to haul cars. I went from one bad employer to stepping right into this guys pile of trouble. he put me in a truck, I went to work. a week into it he calls me to complain about me being "slow". He, like the previous boss, had just started this car hauling company and he new NOTHING about how long it takes to find cars at auctions, or to drive on highways that have traffic lights, or to drive in rush hour, or just anything. It was a venture for him. Well so, needless to say, I was being rushed by him. That caused me to have to rewrite my logbook so I could keep rolling. Then one evening I rolled up to a car dealership,in the snow, in the dark. They closed at 7 and it was 6:45. They had all the lights off except 2 overhead lights by the showroom doors where the car was parked. I did a walk around of the car, I saw no flaws at that time except a few front lower spoiler scrapes under the frontend (normal for low cars actually). I marked it down, got the guy to sign. He wanted a copy, so he made a printer copy, and I went on my way. 2 days later, in the morning, I get where I have to be and unload it and it was real bright and sunny and I find 3 scratched areas I hadn't seen in the dark 2 days earlier. I called my dispatch (the bosses secretary) and told her what I found. She said she didn't know, but had it been signed yet. I said no and so she said to just mark the scratches down on the paperwork and go get it signed, then hurry up and fax it to her so she could make out a bill for it and get paid. So, I did. Then when I got back to where we park the truck when I am in town...the boss fired me. Said it wasn't up to him, it was up to his brother who's name the truck and truckin companies name was in. So I Drove back home to my state. 7 days later, 2 hours before my last paycheck was to get there to me in the mail, the now exboss called me and said he had put a hold on the check because he had been sent a bill for 450.00 for some scratches on that car I delivered, and that he was going to cancel that check and send me the remainder in a a check in a few days. Well after hangin up, I decided,screw that, he owes me money! I went to the bank,cashed the check. Then got to thinking. Then went to the bank the next day and withdrawed all my money and shut the account down. Then sat down with a banker and told him why I did it, and asked what would be the outcome. I was thinking he would say that because the boss write the check, that HE would have to cover it. But instead, he tells me that It would bounce, then come back there, then they would send it to collections, then MY credit would be ruined!! So I reopenned my account, put my money back. Then 2 days later they withdrew the amount of THAT check (which was 602.00), and PLUS 35.00 for the chech bouncing! Now here's the kicker...I had told the exboss the day he called me to email me the contact info and copies of that bill he got for the scratches and repair bill. He hasn't done it, and it's been over a week now. Now I get a check in the mail for the remainder. It's only 89.00. This whole thing is makin me hoppin mad. I am wanting to do something...but this is the first time this sort of thing has ever happened to me and I don't know where to start. And I am currently unemployeed, so hiring an attorney and fighting this thing is going to be next to impossible with no income. Does anybody out there know of some free legal help I can get or know how I can get my money back?

    Ya...I guess that DOT will see that it can't make THEM any money...so they ain't gunna do anything about it. Oh no wait..I take that back...them "people" COULD make some money out of this. They could fine ME for faslifying my logbook! Bunch of pile of something....that smells.

    How is it his fault you chose to park on a ramp and didn't bother to have an up-to-date directory so you could find an appropriate place? Take some accountability for your own carelessness.

    Jesus I'm surprised I have to explain it...but here goes. My boss called. We talked. I told him I didn't know if I could make it all the way through to the drop off tonight. He egged me on, saying I could do it, and if I couldn't, then to at least get as far as I could...so I did. I timed it. I had only so many hours I could drive. I looked at AN UPDATED<CURRENT MAPBOOK. It showed a REST AREA right at the point I was going to run out of hours to drive. So,I shot for there. I got there. It was no more. Not even concrete left. I drove. I was REAL tired, not just a little tired. So I took an exit. It was POURING down rain. I see where other truckers had been pullin off the road there. There was gravel instead of grass,you know. So, I parked it, and went to sleep. 5;30 a.m. I get a knock from johnny law dps. He wants to know why I was parked. I told him there was no rest area and I was out of hours. He didn't care (of course)(a-tipical,by the way). He asked for my logbook and my licence. He wrote 2 tickets. I tried to show him on my mapbook that I was trying to shoot for that rest area,but it was gone, and I was out of hours. HE SAID it had been GONE FOR YEARS now. So my question to YOU is... why is the state still allowing for mapbooks to think there is still a rest area there when there's not???? I think that if it is still on the books as being there, then more than likely we are still paying the taxes to maintain it....even though it's not even there anymore....but that's a differant story. The cop said I couldn't park there. I said THERE'S NO "NO PARKING" SIGNS anywhere here. He said there was, it was out by the highway (some 2 football fields away,by the way). I told him it was pouring down rain when I pulled in there, and I couldn't read it. Now....take a wild guess...do YOU think he gave a flip? Hell no! He actually took joy in screwing me out of my hard earned money, and did it in a way to make it look like I did something wrong on purpose. As far as the logbook violation..it was one saying voilation of incomplete logbook. The fact of the matter is, I didn't know you HAD to finish it before you went to bed. I allways finished it before I got on the road in the morning. The point I wanted to argue in court was the fact that it hadn't been 24 hours yet. Therefore, tecnically it wasn't even another day yet. So I might have been able to skirt that one. But that dumb boss of mine PAID the ticket, instead of taking it to court to keep it off my record like I wanted.
    o as far as it being MY carelessness as you stated....not a chance buddy. I MAPPED OUT my route. And I TIMED it to the T. I was going to end my day at a rest area. BUT....the state of Louisianna decided to remove it, and not take it off the books. So as far as I see it...it is the state of Louisianna's fault I got the ticket.....not mine.

    What town was this missing rest area in?

    Never said it did. That was only a part of what he was whining about.
