You are awarded points against your CSA score for warnings. Also if you drive for a company then their safety rating is effected. If a companies saftey rating gets bad enough then you will get pulled in to scales and DOTed even more.

We have a few drivers in our company that don't like to play by the rules. Now are safety rating is less then stellar which means we get DOTed even more now.

Kinda sucks when other drivers screw it up and it costs you time being DOTed due to other drivers actions.

Only if they were documented on a Motor Carrier Report inspection form.

    #### runs down hill, don't be so quick to blame drivers. These new rules will be interesting to see how they play out and hold up in court.

Just curious why you think that wouldn't hold up in court?

By definition, "warnings" cannot be challenged in court. You can use the FMCSAs Data-Qs process - that might give you a warm feeling for awhile, but that's about it. Your 14th Amendment rights to "due process" no longer apply.

The points - if awarded on a official (screw-you) federal inspection report, are yours for three years.

Want to hear the best part? In one of the proposals (its only on the wish-list so far) the federal government now wants to take your lovely CSA points, and begin suspending your commercial driving privileges for having too many. Ain't that just grand?

I guess I was assuming you meant the CSA data wouldn't stand up in court, I'm just curious to see why. I've read other posts where guys have fought there tickets and got that cleared up but they still carry their CSA points.

Let's see suspending the worst drivers for acquiring deficient notices:biggrin_25511: You mean kinda like we suspend them now for speeding tickets:biggrin_2554:

    Yep that would be lovely:yes2557:

Isn't it funny how when people get close to losing their license they suddenly refuse to violate the law? Perhaps when they come close to losing for their failures maintaining their equipment like they are supposed to............
