Was told today that it's the law that 100% of the FSC must be passed on to the trucker. That true? And a law?
If determined that the above is true and carrier has been stealing some of the FSC..... who gets the call ? Lawyer? Feds?

dont know if it's a law, but if you use a company fuel card, it would be hard to get a case, more than likely the company will say the percentage they take is a charge for using there fuel card

He gets 27% of the billable charges in FSC which is cheap by itself, ( YRC is charging in excess of 50% on a T.L. ) and I get roughly 12%.
Oh, and they charge me to use the card..... between .95 and 1.50 a swipe. -
I like to think of the company that I lease on with like my wife .
If I won't put up with a cheating woman why in the helk would I put up with a cheating company?
I won't even put up with the thought of either one of them cheating LOL !!!
I guess I am lucky and got a good company and a better woman -
All very valid points and I share the sentiment however I am a man of proof.........
Got to know for sure if they are cheating....... suspicion is cheap, proof is invaluable.

There is no law yet about fuel surcharges.
Congress has brought it up a couple of times but it has always been shot down. -
The theory is that the government can not tell a company what to pay their owner-operators. The companies took the government to court in about 1982 with the result that the surcharge was folded into the rates. At that point, I sold my truck. Going from 100% of the surcharge to 67.5% took the profit out of owning, and I went back to company driving.

Appreciate the feed back. If it's not a law then I (we) have nothing but the power of complaint with the carrier and we all know how powerful that is.
We do get full access to the shippers info tho........ I'm wondering if an FYI sent to them would perk their interest. ( I know... I know.... that's the hand grenade I'm throwing behind me as I go out the door )

Last Company I leased to claimed their loads were flatrated, with the fuel surcharge figgered in the rate, I assumed this was for them to get part.
