penalty for false log and driving while out of service in Tx

    You might be looking at a felony for leaving after being put out of service . You might want to check into getting a really good lawyer about now .

    How did the DOT find out he had started out the day an hour earlier than what was logged?
    I'm a rookie here so take it easy on me...

    This :withstupid: has to qualify as one of the least informed posts I've seen all year.

    This didn't "happen" to this guy. He did it to himself. You're going to tell me a driver with 10 years' experience doesn't know any better and a guy from Texas doesn't know how Texas cops operate? Puh-LEEZE!

    No, the CDL "might not" be suspended. It WILL be suspended. How are you at landscaping?

    This is not a felony. It is a serious infraction, right up there with DUI. Hope you have money saved up for your vacation. Was it worth it?

    He was cited for falsification because he admitted to starting his trip an hour before he started his log to have reached the place he was shut down at by the time he reached it.

    The rest of what he related is the really bad part, leaving after being placed out of service before he could legally continue, an extremely huge violation with very serious consequences.

    Here's how: as Loud2ns says, 340 miles at 65mph would take exactly 5.25 hours. But 387 is not a freeway. It has towns all up and down it that you have to slow down for. Traffic lights, other vehicles, etc. It is posted 65mph for most of its length, but you won't be averaging that speed. If you do the speed limit, you might average 55mph. At this average speed, it would take 6.18 hours or, logged on paper, 6.25 hours.

    The cop tried to give him a break and just write him for a log violation rather than a speeding ticket, which he easily could have. But, nope. Our hero had to jump the OOS order. Now his goose is cooked.

    The following is a partial list of some of the violations the DOT has identified as most likely to predict future involvement in a crash and thus has assigned a value of 10:

    Reckless Driving
    Using or possessing drugs or alcohol
    Operating while ill or fatigued
    "Jumping" an Out-of-Service Order
    Possessing multiple licenses
