    Question 4: Are there allowances made in the Federal Motor Carrier Safety Regulations (FMCSRs) for delays caused by loading and unloading?

    Guidance: No. Although the regulations do make some allowances for unforeseen contingencies such as in §395.1(b), adverse driving conditions, and §395.1(b)(2), emergency conditions, loading and unloading delays are not covered by these sections.

    No. FMCSA does not have the statutory authority to regulate shippers and receivers.

    A lot of reading but worth the time so you can be properly informed.

    Wouldn't building a LOT more rest areas CREATE JOBS and make the roads SAFER at the same time? Or is it really about SAFETY? The powers that be can pass laws that make a business that serves alcohol legally liable for their patrons even after they have left the businesses premises but they can't make an h.o.s. rule to help drivers find a safe place to park after a shipper or consignee has eaten up the drivers legal hours by no fault of the driver? Even though the "FMCSA does not have the statutory authority to regulate shippers and receivers", they DO have the power to make provisions/concessions, under those circumstances, for the drivers to find a SAFE and LEGAL place to take a 10 hour break.

    BUT THEY HAVE NOT!!!

    Can't say I blame ya. If I had been doing this for that long and facing these changes, I'd probably say Eff It as well. I've got another dozen years, though. But I'm always keeping my eyes open for the right opportunity.

    Isn't it funny, though. So much technology has gone into these trucks we drive to make them inherently safer and far more comfortable than in years long past. Yet, the paper-pushers in DC that can't even spell the word truck are hell-bent on legislating a "perfect world", (at least in their eyes) because of what they view as problems in the industry, which in turn are at least based upon rules written during the Franklin Roosevelt presidential administration.

    Sad indeed.

    ya know 48 that the reason im giving it up....to many chiefs and not enough indians...not one of them have a clue about the trucking industry yet they want to dictate what is best without even asking the drivers for their imput...yet the companys caved in and said OK...whatever you want we will do... you keep me updated how your doing out there....

    The funny part is at 5 o'clock when they jump in their 4 wheelers and drive like maniacs to get home.

    roadmedic, the drivers you know who got ticketed for P/C. did they have it logged in ther log book before they got pulled over?

    i think there lies the problem, guys plead personal conveyance AFTER they get pulled over and checked. if ya got it in the log when its handed to the officer its say much for the intent, and in fact if it isnt there the log could said to be not current, the same if you dont drop to line 3 when you begin driving.

    and if ya lose at the first court level, you can appeal to the next highest court.


    call and ask treutlen county, ga (soperton, ga) about the idiot(their term) who fought a ticket for a mud flap being to short for 2 years (35 dollar ticket). went to court over 6 times , but i won.

    find out if they had it logged beforehand, be interesting to know

    From what I've seen once you get comfortable operating in the gray, you start to live in the gray. It's good while it's good, but once it goes bad it goes really bad. I'd prefer to stay in the black and white and take the average work to make it better.

    I don't believe in gray areas.

    There is a fine line between black and white, right and wrong, legal and illegal. A gray area is just an obscuring fog above that line. Many folks are unable, or unwilling, to expend the effort to part the fog and find the fine line underneath.
