Court date from a speeding ticket 4 years ago

    Lawyer just called me about a speeding ticket I had got years ago we have been frighting to keep it off my dac and points off my license my queston is if I just pay it and move on is it going to go off the day I'm convected or the date I got this ticket?

    OK, I can't answer your question. But it seems to me, that if it has been four years, you most likely can successfully fight it. Four years is along time. The officer who issued that ticket has issued probably thousands since then. Even if he always takes notes, there is a good chance that he won't have his copy. There is a good chance he won't show up for court. There is a good chance he no longer works for that agency.

    I believe you have a far better chance if you fight this, than you would have had if the court date had been in a normal time frame. What I'd like to know, is how you managed to get it put off for so long?

    If you fight it and win, it won't show up at all.

    Our insurance company goes by infraction date not conviction date

    Well when he called me I forgot all about it but they have had a back log for years the judge had passed away and they didn't reelect anyone until after his turm they are so much of a rear they won't dismiss it even if I pay the fine the cop is still around in the next county lawyer checked on it before he called me
    Lawyer said if I fight it I need to be with him in court in two weeks and if I fight it I'm going to owe him more money this is from oct of 2008 I just didn't want it to be on my license

    i tried that years ago, it goes from the conviction date in NY state (the day you pay the fine)

    That's what I'm worried about I have paid the lawyer over $500 to get to where I'm at the fine is only $128 the dropped it down to $1.00 fine pluse court cost but it's not about the money as long as it stays off my license

    Can they drop it to a lesser charge like inoperable equipment? You would still pay the fine/court costs, but it would not be on your record.

    I agree with this. As of now, you aren't guilty of ANY offence. They can't put something on your licence that you aren't guilty of.
    It goes from date of conviction. At that point your are guilty. It then goes on your record for 3 years or whatever.....

    That's what I'm asking too. But if your lawyer hasn't already tried that, I wouldn't be too confident in him. I mean, I do that myself for tickets I have received in the past over the years. That's just a simple thing that anyone can to.

    If they dropped it to $1 fine & cost's, they may have changed the charges. I would ask. If not, I would have the attorney call the DA & see if you could get that dropped to a non-moving. That will keep it out of court if the court is really backed up that far.

    Ya he has been trying to get it changed but they just won't do it he told them all I want is the points dropped but they said no way even offerd to pay the fine in full but they just won't work with him
