ticket in Cali for driving in left lane...no signs saying not too.

    So I'm headed north up hwy 101 close to San Jose. There are 3 lanes of travel, and I'm in the right lane. Coming up on slower traffic, I move over to the center lane. Then a rollback decides he wants to pass too, so he gets in front of me, and I hit he blinkers and get over into the left lane. No cars in left lane for about a mile, so I'm not hendering traffic. I see CHP roll in behind me and hit the lights. So I cut back across the 3 lanes and pull off. Officer says you can't be in the fast lane in a truck. I said I can't, I didn't see a sign. He said you knew that. I said no, I was unaware that I couldn't or I wouldn't have. So I give him my paperwork and he writes me a ticket for it. Comes back and I said so what's the law so I know it from now on. He says stay in right lane if there are two lanes except to pass. Stay in right 2 lanes if there are 3 lanes...I said anywhere? He said yes that's a state wide law not just a law on that highway.

    I'm sure there are people here that's heard of it, cause I had one of my coworkers say he got one too, for the same thing. The question is, do I have a chance at fighting it, considering there are no signs saying so like they do in other states that don't want you to?

    so what is the state code that he put on the ticket for that?

    I'd be having him in court to prove that one out.

    it is a pretty well known law. I was told in CDL school by an old timer. he made sure to put extra emphasis on it. "DO NOT GET CAUGHT IN THE HAMMER LANE IN THE STATE OF CALIFORNIA!" then he repeated it a second time. You can fight it, but you wont win.

    It's a heck of a thing but drivers are supposed to familiarize themselves with the law in all states for which they drive. As they say, ignorance is no excuse for the law but I'd fight it in court with an attorney since no signs are posted in that area.

    Peeps have gotten tickets for hauling garden tractors with their 4 wheelers.
    Sign entering Ca from I40 says "No trailers in passing lane.
    Speed limit also drops from a comfortable 70 mph in Az to a stiffling 55 once I hit the Cali state line cause I was pulling a bike trailer with my Jeep.

    Uh....Who the Hell writes those codes?.....Talk about improper grammar.....

    Run on sentences and improper sentence structure....

    Oh wait....To graduate from the 12th grade in Cali....All one needs is an 8th grade reading and writing ability.....Then right off to the that cushy government job they go.....:biggrin_25526:

    Same thing happened to me in California near Los Angeles. Trooper said there is a sign when you enter the state & I should have seen it if I was paying attention.

    Please pay your $350 at the window.
    If you drive in Kalifornia, you better learn the local laws. You might be able to get a lawyer to get it dropped to something "Non Moving", but don't count on it. Either way, you'll spend Big Bucks.

    How about this...on my ticket it has my name, address and DL number, then next to the number it says CA for state...I don't have a Cali license I have a MS license...anything there?
