No you don't have to show anything but off duty, you do not have to show jumping in and out of your sleeper if you never move the truck, you can simply show on one log start off duty date, end off duty date. There is now where that states a gross amont of time spent off duty has to show any sleeper berth.

Off duty driving is a change in status from just being off duty. He should have to flag that. Therefore for 6 days on the one log he could of wrote off duty and then if we went to wal mart at 10am. He should have a little mark at 10am that says off duty driving. If that would of happened. There would of been no problem. Some on E logs have the off duty driving option and there are certain guidelines to use it but going from off duty to off duty driving is a change of status. So your previous logs should be updated.

Off duty is off duty is off duty. Once off duty, and bobtailing, the truck is now his personal vehicle. No need to show another mark unless you just want to for your peace of mind. The OP never came back and answered my question as to what were the last marks in his log book. If he never officially went off duty when he first stopped at the Pilot, that was the reason for the ticket.

He didn't get a ticket he got a warning. But he also got shutdown. So I don't see how you can get a warning but shutdown. Of course he didn't come back because obviously he probably left off the part that he was 2 lazy to put that he was off duty when he first stopped at the pilot. But if he would of said that then this thread wouldn't be 12 pages long would it?

395.8(k)(2) The driver shall retain a copy of each record of duty status for the previous 7 consecutive days which shall be in his/her possession and available for inspection while on duty.
If a driver is using the PC exemption (legitimately using it, see my posts on the limited legit uses of PC) then he is off-duty. He does not need to keep a log, it does not have to be current, unless he is on-duty. -

I was told that our CSA score is 97. I looked and see that there are 6 violations. 1 driving, the rest is maintenance violations. I know they stay on there for 2 yrs but is there a limit for the driver before shutting him down?

Ive been OOS once. That's for busting both the daily HOS limits and the 70 rule. The fine was 220 against me in 1988 and a 7 hour hold (Actually 12, but a good nap and wake up revealed a empty area no law) Took the sticker off windshield, threw it into my trash bin inside the cab and rolled.
Company got the CSA hit. It's a statistic essentially related to logbook.
There have been several times where it's easier to take a ticket for not having logs than to get a OOS after that one. -
