When logging off duty when you are at a shipper or receiver do you set yourself up for a loss of workers compensation coverage? If you log off duty and you get out of your truck and get injured workers comp will not cover you and your injuries because you were not working and they only cover injuries that were incurred while at work. Any thoughts as we approach the new rounds of hos regulations I know we will all be trying to keep as much time to use for driving. I was curious if anyone had discussed this issue before. And if workers compensation would not cover your injuries could your company also be excluded from paying for your injuries.

Agreed, It's no different than if you were on line 2 in the bunk and a tree fell on the truck and hurt you or the truck was hit and you were thrown from the bunk........you would be covered.........not to say the carrier wouldn't try to deny.........
And kind of a moot point isn't it ? Last I heard w/c payments were hovering in the $300 a week range. That doesn't go very far these days. The duck would be a better choice and easier to get along with IMO. -
The duck has pretty expensive premiums.
Doesnt matter if your off duty. Your not at home. Your on the job. -
Unfortunately had to go on w/c while back--pay cut sucked lol--but no one ever asked for logs or anything like that--BUT w/c claim or ease of has ALOT to do with ur employer and their attitude
