Of course, that's why I qualified my example by saying I usually have 10 hrs left on my 70 when I break. I could start any time I wanted before 0500 on Sunday with 10 hrs available and 10 hrs coming back at midnight every day until I get home again on friday. I wouldn't even need a restart with the two consecutive periods of 0100 fo 0500 required for a restart under the new rules.

I would assume that if we are required to mark which period we use as a restart, then the EOBR's should allow us to select as well. (it should make us choose really)
You guys were all correct btw. I double checked my question, and for the guys who get home every weekend but sometimes leave on Sunday and some times on Monday, what will happen is when they leave out on Sunday they will likely just have to work off their recap that week and wait til the following weekend to get another 34 hr restart.

Danny: I thought I had read that but wasn't sure exactly where so I didn't want to say "I know" you can attitude.
That's whyI kind of left it open to I belive you can. I haven't checked with qualcomm to make sure they have it in place to allow a driver to select it.
Just like today, it automatically gives you a restart, even though you may not need it. I believe and never checked this could hurt a driver any maybe I am wrong. I never got a chance to figure it out, well to lazy I guess and put it on the back of the burner Now to late to even worry about it. -
The driver must "select" so the qualcomm will probably have to offer some type of option for the driver to select, I could be wrong. My thought is, The computer can't determine the drivers load information based on hours available, therefore the 70 hours/34 hr restart will still have to be up to the driver to determine.
In some cases, I may have 10 hours (or more)available, I might want to run those 10 hours, not take a restart.

I listened to an hour long program last week when Dave Nemo (Road Dog Radio) had with two guys from FMCSA discussing these new rules in detail.
The biggest confusion about the 34 hr rule is drivers think they have to take a mandatory 34 hr break under the new provisions. As I already said, you don't have to. -
if your on e logs you could select to not take a 34 restart with the edit button by droping yourself down to line 4 for 15 min somewhere in the middle of the 34hrs.
