A driver who has a DOT Physical Certification gets another driving job, the new employer sends him to their doctor for a physical. He has had a history of heart problems and the doctor wants him to have a stress test before passing him. The driver leaves and continues driving for his old employer under his present DOT certification.

    Legal????

The driver's valid certification was done by his personal doctor and the doctor that the perspective employer sent the driver to has no knowledge of the driver having it. What is wrong with this picture???

thats why so many companies are requiring a new physical even if you have a current one....because of family doctors "qualifying" drivers...that shouldnt nec. be qualified...

More and more, I can see that the trucking industry is leaning more towards U. S. military health and fitness standards. Eventually, all truck drivers will most likely have to be free of ALL diseases and conditions. I can also see that even borderline conditions with or without the use of medications will disqualify a person from becoming or continuing on as a truck driver.

It would NOT surprise me if weight control and body fat (BMI) standards eventually disqualify slightly overweight to incredibly obese people from becoming or continuing on as a truck driver.

Eventually, it may become as stringent becoming or continuing on as a truck driver as it is to serve in the U.S. military, law enforcement, security, or in any SERIOUSLY SAFETY SENSITIVE JOB.

God bless every American and their families! God bless the U.S.A.!

The way I read this the driver wasn't disqualified at the second physical , the physical wasn't completed .
If things were going as planned and the second physical was completed and the driver was disqualified electronic notification would be sent to the state DMV where his CDL was issued .

That driver needs a stress test. If he can't pass it he has no need to be driving. Soon this will change and for better. It will help drivers stay in shape then eattin fast food every night

that's all well and good, but if we will be held to military fitness standards for active duty to sit in a chair for 11 hours/day, the industry will have to adapt by: 1) dramatically increasing pay, 2) providing ample access to excersise facilities. side note: I worked in a chemical plant for 10 years, HCN,PCL3,anhydrous ammonia, etc. held the lives of 40,000 in my hand every shift. should military fitness apply here as well? all I had to do was pass pulmonary function test yearly so they knew I could wear SCBA. all control room operators were on the emergency response team.
