    I am no lawyer, but what I do understand about the law is that federal law trumps all state laws, so if you do get fired, even though legal in Washington, it is restricted by the government to drive under the influence, so that law would make it illegal. If you smoked and then 5 days later you jump in a cmv and start driving and sometime later you get popped, but it was on hometime, then under Washington state law you were legal, but remember most states are at will employment so they do need a reason to can you. You could have 100 percent on time delivery, come in one day, look at your boss and nod, and he had a bad morning and takes exception to it, or you, he can fire you without cause, unless union, and in the same manner you can quit at anytime without giving notice, and face no repercussions.

    While marijuana does stay in your system for 18 days, it isn't active. And the reason its worth discussing is that it has a shorter active high than someone can be actively drunk. Since alcohol takes around 8 hours or so for it to be completely out of your system.

    Pot is a schedule One drug by classfication. As such all Schedule one drugs inside your body or any person's body is automatically DQ for running safety sensitive positions, particularly with Federal Regulated work such as Trucking.

    The states can do what they do and it's not matter. The FEDERAL Government has the oversight over the states rights and say Pot in any form is still Illegal and STILL disqualifies a CDL Holder which is under Federal Realm.

    If you want change, it will happen at the Federal Level. And even then it's such a altering of the blood brain barrier that it will likely never be approved for CDL and related work where people's lives are in need of protecting.

    This is not about what you do or do not do or rights, laws etc at the state level and below. None of that matters. At the Federal level all CDL is regulated and thus Pot will and is Illegal. End of story. I don't care what people do at home. Personally pot is not my flavor, but if you like it knock yourself out. But you will not be doing that driving a 18 wheeler during the consumption or after the fact while it's in your body.

    At some point this will be either resolved or the Federal Government will reassert themselves to the States who then have only one choice should they want to resist such oversight and that is literally to .. secede from these United States and form their own Nation onto itself. Once they do this, then if recognized by other World Powers as Sovereign in the World, then they can hold Pot to be legal all they want and truckers within their borders can smoke and drive all they want until they pass out or something. I wont be there. It's just the way it has to be.

    Within our system of Lawful Government at the Federal Level there is another path, called Super-majority. Out of 50 states there needs to be a minimum of 32 separate State Legislatures to get together in a Constitutional Convention to legalize Pot. Once you have this success in all 32 or more state houses saying "Aye" and signed by the Governors in all of the mentioned states, it goes into our Constitution and there is that. Settled.

    The problem is we have not had a successful amendment to the Constitution for a very long time. It is not likely you will be able to form and process a Super-majority based convention any time soon and make it all happen. Not without a fight.

    Wrong. There are many laws that the feds can't force onto the states.

    POT is illegal, period.
    Until the FEDS say it isn't.

    It would be easier for some if you would not only use a flat disclaimer but take a moment to explain why it is wrong etc.

    The one thing I am aware of is that the States have powers not specifically given to the Federal Government. But in this case, the Pot is Federally Scheduled One specifically so that it will be illegal without a doctor's express order in a specific medical setting such as use of Ketamine during Trauma situation to help people deal with a chopped up and broken body for example.

    The People chipped away at the states to make this and that legal for this and that and something else. However they also have to chip away at Uncle Sam in Congress to make Pot legal. Which would take about 535 cheechs and Chongs and all their relatives to be elected there. (435 representatives and 100 senators.)

    Yes I am licensed under a state. But my state has to comply with the Federal Real ID act of 2020. Without it I will not be allowed to board domestic flights or enter federal buildings or bases installations.
