vision waiver

    Well couldn't I get a waiver under monocular vision? And in ny yoh need a medical to pretty much even get a cdl

    AL. lets drivers keep driving intrastate with one eye gone not sure if AL. will let you start that way?

    But im in NY and you can only get a cdl in the state you live in

    To the OP, I can tell you right now that FMCSA is looking at 3 years CMV driving experience. I was recently approved for their diabetes waiver. Up until 2005 (or somewhere around there), FMCSA would require diabetics to have 3 years experience. However, they changed it to allow 1 year of driving because most who applied did not meet the 3 year requirement.

    I just looked at the vision packet, I am surprised on the difference of requirements between the 2 programs. Seems FMCSA is really lax for diabetics and quite strict for the other. I imagine before long, FMCSA will lower their requirements for the vision package to be in line with the other program.

    But do they want personal or cmv experience? And how would I go about getting said experience if there's no way to get a cdl in ny unless you want to drive exempted which pretty much means you can just drive for agricultural stuff and fuel emergencies

    Excepted (EI or EA) commerce is when you drive a CMV only for the following activities:

    to transport school children and/or school staff between home and school, or

    as a federal, state or local government employee, or

    to transport human corpses or sick or injured persons, or

    driving a fire truck or rescue vehicle during emergencies and other related activities, or

    primarily in the transportation of propane winter heating fuel in response to an emergency condition that requires an immediate response, such as damage to a propane gas system after a storm or flood, or

    in response to a pipeline emergency condition that requires an immediate response, such as a pipeline leak or rupture, or

    in custom harvesting on a farm, or

    to transport farm machinery and supplies used in a custom harvesting operation to and from a farm, or

    to transport custom harvested crops to storage or market.

    as a beekeeper in the seasonal transportation of bees, or

    driving a vehicle that is controlled and operated by a farmer, and

    the vehicle is used to transport agricultural products, farm machinery or farm supplies to and from a farm and within 150 air-miles of the farm, and

    the vehicle is not a combination vehicle (power unit and towed unit), and

    the vehicle does not carry any hazardous materials that are required to be placarded.

    as a private motor carrier of passengers for non-business purposes, or

    to transport migrant workers (CDL holder must be age 21 or older), or

    you obtained your NYS CDL prior to September 9, 1999 and perform "Non-Excepted" commercial operation (except when transporting hazardous materials) in NYS only. If this applies to you, you must certify to Excepted Intrastate (EA).

    If you drive in one of the activities above, and it is the only operation in which you drive, you operate in Excepted commerce and you are exempt from the requirement to obtain a USDOT Medical Examiner's Certificate.

    If I apply for the waiver with 3 years of only personal driving experience would it be rejected or accepted?

    I feel strong that you will not be able to count personal driving, wavers were made to be able to keep on driving after loss of 1 eye.

    Hopefully the FMCSA changes it to require NO experience. However if they only lower it to one year of CMV experience then everyone in NY and im sure a few other states are screwed if they want to get a CDL permit because the state of NY and im sure a few others doesnt have a intrastate vision exemption therefor meaning that you would be able to drive a CMV AT ALL in NY. Hopefully if they choose to lower the experience requirement to 1 year that they will let someone use personal driving experience when applying for a waiver.

    My trainer had no depth perception. He described it to me as being similar to me watching tv... but all the time, everywhere.
