    Love your way of thinken but that will never happen.They pay by the mile because of all the sitting we do.Would be very sweet if we got paid by the hr like the non trucker staff receives.We have the laws that all non truckers have plus our own laws that the non truckers don't have to follow.Deffinately unfair.

    OTR truckers cannot collect overtime pay as per federal Law....but many interstate truckers have filed lawsuits for it. I think this is were the OP was a little confused.

    New York, NY: Overtime lawsuits are increasing nationwide, particularly in some states where truckers who were at first denied overtime pay may find that their employer has violated the overtime law. Historically, truck drivers are generally ineligible for overtime pay under federal wage and hour law, but not so in New Jersey, and perhaps other states will soon follow its example.

    Although countless employers may not intend to violate overtime laws, and likely a majority of employers are not aware of this recent court ruling, some employers deliberately violate overtime law by a number of devious tactics. One common violation is to pay truckers by the mile instead of by the hour, i.e., if you have been paid the same amount per mile for hours worked over the 40 hours in the week. Another common practice is to intentionally misclassify truck drivers as contract drivers.

    Another possible solution could be this.

    Totally do away with mileage pay and pay the OTR truck driver by the hour, based on a 168 hour work week, (24 hours a day X 7 days a week = 168 hours).

    The starting pay would be the federal minimum wage of $7.25 an hour plus time and 1/2 after 40 hours, ($7.25 an hour X 1.5 = $10.875 an hour).

    1) $7.25 an hour X 40 hours = $290.00

    2) $10.875 an hour X 128 hours = $1392.00

    3) Total for the week would be $1682.00

    If the federal minimum wage does go up to $10.10 an hour, that would $404 for 40 hours. Anything over 40 hours would then be $15.15 an hour, ($10.10 X 1.5 = $15.15).

    However, an adjustment would have to be made to keep the trucking companies in business.

    Have as close to 100% as possible all employees of the trucking companies getting their CDL's. Once this happens, train everyone of them to become OTR truck drivers.

    After they have been trained, ROTATE all the CDL holders out onto the road, while bringing the OTR drivers into the terminals to work at other jobs, ranging from office jobs, warehouse jobs, to maintenance jobs. They would have to be trained to work the various other jobs.

    Eventually, there would be no full time OTR drivers out on the road. Instead, there would a company of all the OTR drivers being solely ROTATIONAL drivers, being out on the road anywhere from 1 week to 1 month at a time.

    This way the drivers who are out on the road would be paid for all their hours while being out on the road. In the mean time, the the drivers brought back to the terminal would still have a job earning a paycheck, until it was their turn to go back out onto the road.

    Also, the OTR drivers who would have normally been out on the road for long extended periods of time would now have much more QUALITY TIME with their families.

    A wheel is round. It's a circle. No need to reinvent it.
    Sounds like some of you are getting screwed. A change of job would be easier than a change of federal law IMHO.
    You really think that the bottom feeder companies wont find a way around hourly pay? Yeah ok...

    I get paid hourly. $20 for driving and $12 for all line 4. Works quite well. I've been paid mileage (scam), percentage (decent but still working for free on line 4), and now hourly and hourly is the best. I'm considered regional as I'm home every Friday and leave Monday.

    Stop driving for the antique way of mileage pay. We do a lot of work on line 4 why shouldn't we get paid for it? Isn't it technically illegal to have people working and not paying them for the work being done?

    The federal law allowing piece work and eliminating overtime for truck drivers is nothing but a subsidy. A law lobbied in by trucking companies, under the pretense that it is hard to manage employee's time half way across the country. That time is long over and these companies have no legitimate excuse for their behavior. After burning through 100% of their employees each and every year, they cry to the government for more training dollars and paid work subsidies. I see no need for my tax dollars to pay for these companies crapping on more workers.

    Switch all companies to hourly pay and mandated qualcomm so they can keep track of the actual hours. Very simple.

    With your pay rate my drivers would make less gross than they do now! But you are getting closer and we pay in your words, scam rate (hub miles).
