had the same thing happen to me in the early 70s,in nebr. at the old scale at hwy 20 and 275. tried to hold me up for a old over weight fine on a other o/o leased to same company. didnt know what to do so called the state police on the pay phone outside the scale house,when the state cops showed up they had a discussion inside the scale house i was not privy to. a few minutes later the trooper came out and told me i was free to leave. of course no one said sorry about the three hours i was held up at the scale. that scale master was suppose to know the law i had know idea why he was jerking my chain over a two year old scale ticket that was not mine,and he knew it was not mine. be safe out there

Update.. the original fine was an overweight ticket to the driver, which the company was supposed to pay or reimburse. Either the driver never reported it or the company just never paid it.

Define ticket?
What I mean is that the enforcement people will hold the truck when there is a citation for a violation and this is not a driver's issue but a company issue.
Most of the time people don't even bother to read how the system works, you get inspected, they find a violation and then they write you up. You sometimes get a fine right there but many times you get nothing and the company has the burden to deal with it. They have a few days to respond to the violation (that's the thing where they sign off on it and it gets faxed to the state) and then the state either does its thing by setting a fine or does nothing. When the company does nothing and let it sit, the enforcement officer can hold the truck until the fine is paid or the problems are corrected.
There is no bs about it, the driver is the representative of the company and in being one is still responsible for the truck they drive.
Infringement of liberties?
Oh come on, there isn't any here, he is working in a regulated industry.
His company should have cleared up the matter by themselves, IF it was me, I would have told them I'm not paying a thing unless I get compensated for my delay (at least $200) and the use of my money (another $100) and if not, they can pick up the truck.pattyj Thanks this. -
Ya but what good is that.Where is he going to go on foot with all his belongings in the trk.I see what you're saying and it makes since.But its still not fair to that driver.Why should he be subjected to someone elses ticket.Had I been that driver,I wouldn't have moved till the company paid the ticket.If scale houses are like court houses,they take credit cards over the phone.

We are all just glorified ATM machines to the DOT. Just pull us over and make a withdrawal. We literally have no civil rights. They can pull us over, search the vehicle from top to bottom and charge us with anything they find with no probable cause. Truckers are the only Americans that have no civil rights and no civil recourse.
