My brother, who is also a OTR car hauler called me today to tell me that the Troutville scale in VA held him because of another company drivers past unpaid ticket. They said he could not move his vehicle til the overdue ticket was paid. This was NOT his ticket. What BS is this? How can they legally hold him for something he is not responsible for? Infringment on liberties? He called his company and they are reimburseing him, but it's still ridiculous! Has anyone else experienced this?
Held at Va Scale, someone else ticket?

It sounds like they are intervening with the company. The driver just happens to be in the truck. The company should take care of business.

But if the ticket is not legally his responsibility, what right does the state have to hold him? They would not give him any information because it is not his, just how much the ticket was and he would have to pay before he could move. This is profiling at it's best! What happens when bigger carriers start having drivers sit at scales because they dont have the $ to pay someone elses ticket??

It could have also been a company fine and not a driver fine.

I've never heard of this before, but I'm pretty sure there is no law backing this up. Someone please correct me if I'm wrong, but if he were to drive off, could they legally do anything about it? Could he be arrested? If so, for what?
It's a sad day when truckers become responsible for other truckers' legal fees, just because they happen to be employed by the same company.
I do understand that it is probably a company ticket, but that driver that is being detained is not at fault. He is basically a hostage. Being punished because he doesn't have enough money to pay SOMEONE ELSE'S ticket.
I am usually one to try and look on the bright side and side with our law enforcement if at all possible, but things like this really put a dent in my faith. Unless there is something missing from this story that we do no know, then it is not right in any way for them to hold him for something that has nothing to do with him.Last edited: Apr 20, 2014

I've had lumpers attempt to do this to me, when a company driver... Say another driver ran out on his lumper fee and they told me I'd have to sit until someone paid it. But never the DOT.
This isn't a good sign. I'd advise a cab ride and some hunting for new employment wouldn't hurt either. -

I've seen this happen twice with a very large carrier due to unpaid fines that were missed due to incompetence or a regular old snafu. I'm pretty sure the state the last time was Connecticut.
