Banning all old trucks after 2015?

    each state in these UNITED states is supposed to have virtually complete autonomy to do as they please

    of course, that has its own set of circumstances, but that was the way it was supposed to be

    Not to make this a political discussion, it is still the way it works. California has zero power to tell another state what to do, in this case tell a vehicle owned in another state what they have to have in order for that vehicle to go into California, this is the limitation of the states as they agreed to by adopting the constitution ( in the case of California after the initial ratification if it ) and through the years there has been a few agreements to harmonize the laws between the states to ensure that there are no issues for the people to travel.

    Furthermore the constitution also states there is no limitation on travel between or within the states, which boasters the idea of a limit to privileges of any state where they place strict limits on travel of any citizen for any reason. The state of California can cite someone for driving a truck but then the citizen's rights of free travel are above and beyond that of the state and the citation is in effect null and void by the constitution.

    theyre not doing anything to others state's trucks. if you don't like it, don't go to California.

    It will be interesting to see how OOIDA's law suite agents CARB goes as they are suing based pretty much on what you are saying (http://www.ooida.com/MediaCenter/PressReleases/pressrelease.asp?prid=335).

    OOIDA contends that the CARB rules violates the Commerce Clause. The Commerce Clause prohibits state laws and regulations that discriminate against interstate commerce or unduly burden interstate commerce.

    I'm not holding my breath and betting on their winning although I do think that they (and you) are correct.

    Actually they are. They are saying that in order for a truck to enter California for the purpose of interstate commerce, they are required to have special equipment that is only required in California. No other state has adopted the CARB regulations and not likely going to force a retro fit of them to older trucks. The issue is clear, does California have the right to limit their markets through limiting the means of transport or is this an exclusive right of the federal government. The upside for us is the sc upholds their mandate of regulating commerce the downside is that they say that it is California's right but than that downside will open the flood gates for a lot of lawsuits on everything from the regulations we work under becoming meaningless to agriculture programs to drug programs to Obama care.

    Gub'ment is ultimately setting it up to where only the mega carriers can survive ,
    it gives them more control over "public safety" .... ( air quality falls into public health )

    the Feds derive all of these things under the interstate commerce clause - it gives them their power.

    Can't see it happening ... How can they just announce that your asset being your old truck that is earning you your living is now effectively useless and therefore worth $0..?? If they are truly that hell bent on getting everyone on new trucks and new emissions, why not just close the loophole for glider trucks to be built ... say any new truck bought has to have the emissions crap on it, and whatever is on the road today can just continue operating until they all eventually die ... Not to mention what it would do to anyone who is operating a used truck lot ...
