Unsafe Operation Violation

    I was talking to a recruiter and apparently I had a violation for unsafe operation of a CMV. They sent me a copy of the report, and it does not state any code or state the violation was received in, it's just there. The date the violation occurred I believe was the time I got a violation for defective equipment (bad tire, and an applied air brake leak that I would have never caught if it weren't for the inspector). I looked up this violation for the state of California (where I received these violations) and it appears to be one given out in the event you do something that causes injury to another person. I did not have an accident (not even close) so I don't know how I could have gotten this. Could this be something the inspector incorrectly reported?

    Go to Hireright.com

    You can get a free copy of your DAC report by filling out a request for it. (That's the same report employers get on you) It should list the violation on that report, including the date, time, where it occurred and everything. Once you get it you can dispute any info that is incorrect on it. You can get 1 per year free. I get one every year to make sure nothing gets put on it that shouldn't.

    If its unsafe operation of a motor vehicle, it will be on his DAC regardless to whether its on his mvr. Unsafe Operation always goes on your DAC

    Thanks. I couldn't remember what that site was lol. The report she sent me via email was from that same company. It didn't list a state or anything.

    Not always the case. If the employer doesn't use or subscribe to the hireright people it won't be on there.

    You may have gotten the violation in CA, but your home state CDL may not have the exact corresponding violation so they fit it as best they can.

    If in your home state those violations may also come under the definition of unsafe vehicle operations.

    When you get any violations in any state other than your home CDL state, your home state classifies it as best they can to their own set of regulations, sometimes if you get really lucky your home will ignore a violation from another state if that item is not classified as a violation within their jurisdiction.

    The most frequent time this happens is with lane usage violations.

    Ive still got one on my DAC from 10 years ago issued by and reported to DAC by the state of Virginia.
